He stated he does want <br />to see the Legion come into the City. He expressed concern regarding the use of that site. <br />He added that using a pole barn is not the best situation. He stated he may support the <br />plan if there was a well laid out landscaping plan and a fence is installed. He asked about <br />the location of the ditch. Mr. Powell pointed out the location of the ditch stating it is <br />along the rear of the property. The pond will be maintained by the property owner. The <br />City will have an easement over it and can step in if it is not properly maintained. <br />Mr. Corson made a MOTION to close the public hearing at 7:14 p.m., and was supported <br />by Mr. Dunn. Motion carried 6 -0. <br />Mr. Dunn stated the City needs to be aware of the Comprehensive Plan. The plan for the <br />Legion is consistent with the land use indicated in the Comprehensive Plan. He stated he <br />would prefer to see a living wall of spruce trees. He also stated a stipulation should be <br />made that a building permit is not granted until all conditions are met. He asked about <br />any noise abatement within the facility itself. He suggested the possibility of containing <br />the noise in the building. The issuance of a liquor license is up to the City Council. He <br />asked that condition #10 be modified to include a stip on regarding the granting of the <br />building permit. <br />Mr. Corson stated he is in favor of a fence bec <br />wandering into resident's back yards. He added that staff is unsure about how much noise there will be. <br />Ms. Carlson stated the issue is keeping the noise down and not in. <br />Mr. Dunn stated that if noise is going to be created it is easier to fix at the beginning of a <br />project. Any applicant must evaluate the cost of doing things now or after the building is <br />completed. <br />Mr. Schilling noted there is an acoustical product on the market that the applicant should <br />consider. <br />Ms. Carlson stated the area is planned for commercial use and will be zoned general <br />business. She stated she sees the Legion as more neighborhood friendly than a different <br />business that could be allowed. She stated she appreciates that the Legion is willing to <br />
