• <br />Record of Decision <br />City of Lino Lakes <br />DNR has requested that a botanical survey be conducted in the project area. It <br />is recommended, the survey be conducted by individuals with previous <br />experience and when the plant species are in bloom. <br />Mr. Jason Huseth, Senior Biologist at Tetra Tech EM Inc., and Mr. Marty <br />Asleson, Environmental Specialist for the City of Lino Lakes completed a <br />botanical survey at the proposed project site on July 17, 2003. In summary, a <br />thorough field review by Mr. Huseth and Mr. Asleson encountered none of the <br />above species mentioned in the above paragraph. The proposed project site <br />was primarily maintained as non - native herbaceous old -field vegetation, <br />dominated by Smooth Brome (Bromus inermis), Kentucky Blue Grass (Poa <br />pratensis) and Reed Canary Grass (Phalaris arundinacea). Anoka County Ditch <br />10 and several smaller laterals along its extent contained primarily second <br />growth woodland vegetation dominated by Box Elder (Acer negundo), Elm <br />(Ulmus americana), Buckthorn (Rhamnus carthartica) and Hackberry (Celtis <br />occidentalis). <br />Focused searches were conducted in isolated depressions for suitable habitat for <br />such species as Lanced - Leaved Violet (Viola lanceolata), Autumn Fimbristylis <br />( Fimbristylis autumnalis), Tubercled Rein - Orchid (Platanthera flava), Marginated <br />Rush (Juncus marginatus), Clinton's Bulrush (Scripus clintonii; State Special <br />Concern), and Cross Leaved Milkwort (Polygala cruciata; State Endangered). <br />No rare species were found within the limited suitable habitat. <br />Based on the findings of July 17th, 2003 field survey of the proposed project area <br />and the absence of state - listed plant populations on the site, it was concluded <br />that no rare plant populations would be directly impacted by the proposed <br />development activities on -site. <br />Wetland Impacts <br />The proposed plan will not require the alteration of the wetlands on the site. In <br />the event future development does encroach upon on -site wetlands, under the <br />Minnesota Wetland Conservation Act (WCA) the Rice Creek Watershed District <br />(RCWD) acts as the LGU for wetland impacts. The RCWD will assume wetland <br />alteration permit authority over any wetland impacts. <br />Anoka County Ditch No. 10 will be preserved in its existing condition. <br />Water Related Land Use (Shoreland and Floodplain Impacts) <br />The very eastern portion of the site is located within the designated shoreland <br />zoning district for Marshan Lake. The City has adopted a shoreland and a <br />floodplain ordinance that regulates development within these designated areas. <br />The DNR has approved these ordinances. The proposed development will be in <br />compliance with the standards of these ordinances. <br />
