• <br />City Council <br />Marshan Lake Industrial Park <br />September 22, 2003 <br />Drainage and Utility Easements. Drainage and utility easements are required. <br />Drainage and utility easements at least ten (10) feet wide shall be provided on all <br />exterior lot lines, and centered on common rear and side lot lines. Easements <br />are also required around wetland and ponding areas. These drainage and utility <br />easements are shown on the plat in conformance with City requirements. <br />Additionally, a 100 -foot wide drainage and utility easement covers the entirety of <br />Anoka County Ditch Ten. <br />A separate ingress /egress easement for maintenance purposes will be required <br />across Lot 2, Block 1, for City access to ponding areas. <br />Floodplain. The portion of the site which bounds County Ditch Number 10 lies <br />within a Flood Plain Zone A. This affected portion of the ditch runs generally <br />east -west across the northern portion of the property. Zone A represents areas <br />of 100 year flood where base flood elevations have not been determined. The <br />City's Floodplain Management Ordinance requires that all principle structures be <br />located no lower than one foot above the regulatory flood protection elevation. <br />The remainder of the project is locate in Zone C, a non -flood plain area, and no <br />impacts to the flood plain are proposed as a result of the project. <br />Wetlands. The project site contains 1.5 acres of wetland, comprising two <br />wetlands: one on Lot 3 and one on Lot 4. No filling or alterations of the wetlands <br />are proposed as part of the project. <br />Environmental Assessment Worksheet (EAW). Minnesota Rules Chapter <br />4410.4300, subpart 14 requires the preparation of an EAW for industrial and <br />commercial projects that exceed a gross floor space threshold of 300,000 sq.ft. <br />for 3rd or 4th class cities. Because subdivision of the property provides the <br />potential for this threshold to be exceeded, an EAW has been prepared. The <br />EAW was reviewed by the City's Environmental Board on July 30th, and <br />approved by the City Council for distribution and comment on July 14, 2003. The <br />required 30 -day public comment period ended on August 20tH <br />Minnesota Statute 16D.04 prohibits final decisions on a proposed project until a <br />negative declaration on the need for an Environmental Impact Statement (EIS) is <br />made. <br />Rice Creek Watershed District (RCWD). A RCWD Land Development permit is <br />required for the proposed project. The RCWD Board reviewed the application on <br />August 13th and approved a CAPROC (Conditional Approval Pending Receipt Of <br />Changes). <br />Anoka County. Plans have been forwarded to Anoka County for review. An <br />Anoka County access permit onto Lake Drive for the proposed roadway will be <br />required. It is also likely the County will require the dedication of right -of -way <br />along Lake Drive, dedication of access control for Lot 1 and Lot 4 that abut Lake <br />
