Clearwater Creek 3rd Addn. <br />Comprehensive Plan Amendment, Rezone to PDO <br />PDO Development Plan <br />March 22, 1999 <br />page 9 <br />4. Developer will move trail alignments near Lots 1 & 2 Block 1 and Lots 1 & 2 Block 5 <br />if possible to allow a better connection with other trail segments. Exact trail <br />alignments throughout the development will be established with Parks staff. <br />5. The developer will need approvals from Anoka County for the new road access to <br />Otter Lake Drive. The developer also will need to meet any County requirement for <br />additional ROW on Otter Lake Rd (CR 81). <br />6. A tree preservation plan and street tree landscaping plan must be submitted for review <br />by the City Environmental Specialist. Noise abatement to address freeway noise <br />should be considered in this plan. <br />7. All permits required by the Rice Creek Watershed District shall be obtained prior to <br />any site grading. <br />8. Utility, grading, and drainage plans must obtain approval from the City Engineer and <br />Rice Creek Watershed District. <br />9. The City Engineer's comments in his memo of March 4, 1999 must be addressed to <br />his satisfaction. <br />10. Drainage and utility easements to be held by the City shall cover all wetlands and <br />drainage ways subject to approval of the City Engineer. This includes lot line <br />easements as required by the City Subdivision Regulations. <br />11. A development agreement will be required. <br />12. In addition to normal City requirements, the development agreement will require that <br />a homeowners' association be created. Association by -laws shall be subject to review <br />by the City. The homeowners' association will own the open space areas. Deed <br />restrictions must be included to address protection of the common open space areas. <br />A management plan for the open space must also be prepared. <br />13. The minimum house sizes in the R -1 zone shall apply in this PDO. <br />PLANNING & ZONING BOARD ACTION <br />At its March 10 meeting, the P & Z Board considered the applications and held a public <br />hearing on the Plan amendment and rezoning. The P & Z voted to recommend approval. <br />
