to his estimated completion dates for removal of the dirt and brush piles and the <br />boulevard tree plantings are attached for information purposes. <br />Staff, at the direction of the P & Z, met with Mr. Uhde and his engineer to discuss <br />completion of the grading and pond work. There will be a letter sent to residents <br />surrounding the pond detailing what can and cannot be done on the edge of the wetland <br />in regard to plantings and earth work. This letter will be prepared in conjunction with <br />staff and the Rice Creek Watershed District. In addition, the Developer will meet with <br />the residents in mid April to make certain all concerns have been addressed. Dirt piles <br />and debris will be removed by mid June and a construction access on the north side of the <br />pond will be discontinued and regraded. Staff will visit the site in June to insure <br />completion of these items. <br />Staff recommended approval of the revised preliminary plat and the P & Z concurred on a <br />5 -0 vote with the conditions outlined below. Included in the approval is the variance for <br />Lot 7, Block 4 and the cul -de -sac length. <br />1. Permits are obtained from the Rice Creek Watershed District , the U.S. Army Corps of <br />Engineers and Anoka County for access to Sunset Road. <br />2. Grading, drainage and utility plans are approved by the City Engineer. <br />3. Drainage and utility easements are provided along all lot lines and placed over <br />designated wetland & drainage areas subject to the review and approval of the City Engineer. <br />4. The plat is redrawn to eliminate the need for the lot depth variance on Lots land 2 and an <br />easement for trail purposes is provided over the drainage and utility easements on these lots that <br />connect to the trail segment provided on the plat. <br />5. A variance is granted for lot width on Lot 7, Block 4 and the cul -de -sac length for Palomino <br />Lane <br />6. A detailed landscape plan and tree preservation plan is submitted which addresses screening at <br />the periphery of the plat and reduces the visual impact of the subdivision from adjacent properties <br />outside the plat. <br />7. The developer shall provide a disclosure statement for all properties abutting trails. <br />8. The developer shall remove all brush and dirt piles surrounding the pond as detailed in his <br />letter to residents of Behm's 2nd Addition dated 3/4/99. An additional neighborhood meeting will <br />be held in late April to insure resolution of neighborhood concerns. <br />OPTIONS: <br />1. Approve revised preliminary plat with conditions outlined above. <br />2. Return to staff for further consideration. <br />3. Deny amended preliminary plat request. <br />RECOMMENDATION: <br />Options 1, 2, and 3 <br />
