JADT PDO, Plat, Site Plan, CUP <br />April 26, 1999 <br />page 2 <br />PDO REZONING, DEVELOPMENT PLAN/PLAT <br />The site currently is zoned SC Shopping District. It was recommended in the Interchange <br />Study, which is part of the existing Comprehensive Plan, to create a planned development <br />for the entire northeast quadrant area. This PDO is the first step in carrying out that <br />recommendation. <br />Typically, no rezoning application that has been denied can be resubmitted for a period of <br />twelve (12) months unless specifically allowed by the City Council. The City Council <br />voted at the March 22 meeting to allow this applicant to resubmit before the 12 months. <br />Design Standards. <br />Future phases of the PDO will undergo site plan reviews. The Town Center guidelines for <br />this area will be compiled in the next few months. To ensure that any development in <br />this PDO that occurs before that is governed by some standards, an adaptation of the site <br />plan review design standards, Section 2 Subd. 5.D. of the Zoning Ordinance have been <br />added to this PDO. The design standards also include the "Design Framework" <br />September 1998, revised March 23, 1999, submitted by the applicant, with changes as <br />specified here. Future phases will be reviewed individually. <br />The intent is that review of future projects in this PDO will fit in with the Preservation <br />Development approach to new development. <br />Phase I (McDonald's site) shall be as in the approved site plan. Other than Phase I, all <br />development in this PDO shall comply with the following design standards: <br />1. The site and buildings shall be designed, constructed and maintained to avoid <br />substantial probabilities of: <br />a. Unnecessary detraction from the appearance of the surrounding area or the City as <br />a whole. <br />b. Aesthetic incompatibility. <br />c. Noise incompatibility. <br />d. Traffic pattern incompatibility. <br />e. Accelerated erosion. <br />
