Much research and public <br />participation went into the preparation of the land use policies and recommendations in <br />the draft 1998 Plan. The result was a recommendation to guide this site for commercial <br />uses. <br />2. The proposed use is or will be compatible with present and future land uses of the <br />area. <br />The draft 1998 Comprehensive Plan discusses extending commercial uses along Lake <br />Drive while ensuring compatibility with adjoining residential neighborhoods. The <br />question here is what types of commercial uses are appropriate for this area of the City. <br />The existing Neighborhood Business zone allows uses of less intensity than those in the <br />General Business district. <br />The attached Appendix 1 compares the uses in each zoning district. <br />Any commercial development must be designed to protect the residents to the west of the <br />site from negative impacts. The proposed design of the Legion site is addressed below in <br />the discussions of the CUP and site plan. <br />3. The proposed use conforms with all performance standards contained herein. <br />With the design changes recommended in this report, the use would conform to <br />requirements. This includes screening, tree replacement, and other amendments or <br />additions to the submitted information. Specified conditions of approval can ensure <br />conformance with City requirements. <br />4. The proposed use can be accommodated with existing public services and will not <br />overburden the City's service capacity. <br />The new utilities along Lake Drive can accommodate development in this area. <br />S. Traffic generation by the proposed use is within capabilities of streets serving the <br />property. <br />The amount of traffic generated will not overburden the roads. When planning to market <br />the four acres together, City staff were planning to eliminate some direct access <br />driveways onto Lake Drive in response to the County's initiative to reduce access for <br />safety reasons. This would involve creating a common access road or drive that serves <br />the four lots. One end would provide access to Lake Drive and the other end would <br />provide access to 77th St. This would be safer than numerous individual driveways onto <br />Lake Drive. It also follows the recommendation of the draft Comprehensive Plan to <br />consolidate access points to reduce traffic conflicts. <br />
