Will not create excessive additional requirements at public cost for public facilities <br />and services and will not be detrimental to the economic welfare of the community. <br />f Will not involve uses, activities, processes, materials, equipment and conditions of <br />operation that will be detrimental to any persons, property, or the general welfare <br />because of excessive production of traffic, noise, smoke, fumes, glare, or odors. <br />g. <br />Will have vehicular approaches to the property which are so designed as not to <br />create traffic congestion or an interference with traffic on surrounding public <br />thoroughfares. <br />h. Will not result in the destruction, loss, or damage of a natural, scenic or historic <br />feature of major importance. <br />i. Will conform to specific standards of this ordinance applicable to the particular use. <br />The site is in the MUSA and utilities will be available along Lake Drive. Site design with <br />• <br />complete landscaping that provides suitable screening is important to avoid negative <br />effects from the design. <br />• <br />To reiterate the economic development issue, the City's original plan was to market all <br />four acres together for economic development. The Legion's proposal would reduce this <br />to three acres. Four acres would be easier to market, especially with the plan for a <br />common access drive. In addition, the other three acres must be designed around the <br />existing building that would house the Legion. <br />As to the proposed use itself, there is no reason to object to an American Legion per se. <br />However, there is reason to examine the location and surrounding uses when considering <br />this site for a club such as the Legion. On a regular basis, bars generally are open until <br />1:00 a.m. In addition, large events would be the greatest concern. For example, a <br />wedding reception that runs late may result in noise that impacts the neighbors. The <br />closest house is approximately 270 feet from the rear property line. <br />Originally, the Legion proposed to remove a stand of trees on the back of the site that <br />provided a visual screen. Commercial uses that abut residential property must provide <br />complete visual screening along the boundary. The screening issue is important and is <br />addressed fully as part of the site plan review to avoid repetition. <br />Neighborhood Concerns: A number of neighbors attended the June 9 meeting and four <br />expressed opposition to the project. The common concern was opposition to a bar at this <br />location for reasons of noise and safety. The noise from wedding receptions was another <br />concern. A resident with a licensed daycare facility expressed concern over how it would <br />
