N.W., ANDOVER, MINNESOTA 55304 <br />(612) 862 -4200 FAX (612) 862 -4201 <br />RE: Site Plan <br />Shirley Kaye's Sports Bar /Grill <br />Dear Mary Kay, <br />April 14, 1999 <br />We have reviewed the Proposed Grading and Erosion Control Plan for Shirley Kaye's Sports <br />Bar /Grill, located on the southeast side of CSAH 23 (Lake Dr.) within the City of Lino Lakes, and <br />I offer the following comments: <br />Existing Right of Way adjacent to CSAH 23 should be adequate for future <br />reconstruction purposes. It appears that portions of the proposed bituminous <br />parking lot are within Anoka County Right of Way. Encroachments of this nature <br />are not permitted by ACHD and parking setbacks regulated by the city should be <br />enforced. It also appears that an existing sign is located within Anoka County <br />Right of Way. This sign is to be removed from Anoka County Right of Way <br />unless the owner enters into a License Agreement with Anoka County allowing <br />the sign to remain. For your information and use I have attached a copy of the <br />pertaining portion of a Minnesota Highway Department Right of Way Map which <br />shows the right of way as it was when TH 49 was turned back to Anoka County. <br />It appears that both the existing and proposed buildings will become obstructions <br />to Case I sight distance requirements for an access as shown on the site plan. <br />The proposed access should be slid to the northeast to a point where the <br />buildings will be outside of the Case I sight distance triangle. The access <br />approach to CSAH 23 should also be re- graded to a higher elevation to improve <br />intersection sight distance. <br />It appears that this site includes Lot 13, Lot 14, and Lot 15 of Auditors Sub. 151. <br />Our records show that right of access to Lot 13 from CSAH 23 has been <br />dedicated to Anoka County with exception of the southwesterly most 33 feet. It <br />does not appear that right of access to Lot 14 or Lot 15 was dedicated to Anoka <br />County. A 30 ft. wide access to Lot 14 or Lot 15 is acceptable provided it is <br />located where sight distance requirements can be met as mentioned above. <br />Anoka County Highway Department will install the appropriate traffic control <br />devices within County Right of Way for a commercial access to this site. <br />Affirmative Action / Equal Opportunity Employer <br />
