Adequate screening from abutting residential uses and landscaping is <br />provided in compliance with the landscape and screening regulations <br />of Section 3 of the zoning ordinance. <br />3. Adequate off - street parking and access is provided on the site...and <br />such parking is adequately screened and landscaped from <br />surrounding and abutting residential uses in compliance with the <br />ordinance. <br />4. Adequate off- street loading and service entrances are provided and <br />regulated where applicable by Section 3, Subd. 6 of this ordinance. <br />Additionally, the use is subject to standards for a conditional use permit. The <br />ordinance defines a conditional use as a land use or development that may not <br />be appropriate generally within a certain district but may be allowed in that <br />district with appropriate restrictions, conditions or limitations as imposed by the <br />City Council. If findings can be made that all of the standards are satisfied for a <br />conditional use in a specific location then a conditional use permit should be <br />granted. However, if the use is not appropriate based on the criteria then a <br />permit does not have to be approved and findings should be made as to why the <br />use does not satisfy the standards for granting a conditional use permit. <br />The ordinance states that the Planning and Zoning Board shall recommend a <br />conditional use permit and the Council shall order the issuance of such permit <br />only if it finds that such use at the proposed location: <br />1. Will not be detrimental to or endanger the public health, safety, <br />comfort, convenience or general welfare of the neighborhood or the <br />City. <br />2. Will be harmonious with the general and applicable specific plans and <br />policies of the comprehensive plan of the City and this ordinance. <br />3. Will be designed, constructed, operated, and maintained so as to be <br />harmonious and appropriate in appearance with the existing and/or <br />intended character of the general vicinity and will not change the <br />essential character of that area. <br />4. Will be served adequately by essential public facilities and services, <br />including streets, police and fire protection, drainage structures, refuse <br />disposal, water and sewer systems, and schools; or will be served <br />adequately by such facilities and services provided by the persons or <br />agencies responsible for the establishment of the proposed use. <br />5. Will not create excessive additional requirements at public cost for <br />public facilities and services and will not be detrimental to the <br />economic welfare of the community. <br />6. Will not involve uses, activities, processes, materials, equipment and <br />conditions of operation that will be detrimental to any persons, <br />property, or the general welfare because of excessive production of <br />traffic, noise, smoke, fumes, glare, or odors. <br />
