WHEREAS, by order dated October 8, 1981, the Minnesota District Court, <br />Tenth Judicial District, the Honorable John F. Dablow, Judge of District <br />Court, presiding, did determine that, because in the Court's view the <br />project as ordered by this Council varied from the improvement as origin- <br />ally petitioned for, four affirmative votes of the Council were required to <br />order said project pursuant to Minnesota Statutes, Section 429.031; <br />WHEREAS, pursuant to duly published notice of sale, this Council <br />adopted a Resolution at a special meeting on September 17, 1981, entitled <br />"Resolution Awarding the Sale of $2,150,000 General Obligation Temporary <br />Improvement Bonds of 1981; Fixing their Form and Specifications; Directing <br />their Execution and Delivery; and Providing for their Payment;" <br />WHEREAS, this Council has by Resolution adopted on this 15th day of <br />October, 1981, and in response to the above - mentioned District Court order, <br />ordered a portion of the originally petitioned for sanitary sewer improve- <br />ment project, pursuant to Minnesota Statutes, Section 429.031, subdivision <br />1, more particularly, for sanitary sewer on Highway 49 along the petitioned <br />for route, northerly to Interstate Highway No. 35W, and there terminating; <br />WHEREAS, the engineers for this project, Orr, Schelen, and Mayeron, <br />have by letter dated this 15th day of October, 1981, presented a revised <br />engineering report to the Council concerning the above - mentioned reduced <br />project and have further indicated that said revised project is feasible <br />and have estimated a total cost of $1,600,000 for said project; <br />WHEREAS, in order to avoid an overissuance of the bonds sold on <br />September 17, 1981, and with the prior consent of the purchaser thereof, it <br />is necessary to reduce the size of said bond issue. <br />NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City <br />of Lino Lakes, Minnesota, as follows: <br />1. The reduced project mentioned above as ordered this day by this <br />City Council involves the following expenses: <br />Construction Contracts, Engineering <br />and Contingency $1,162,000 <br />Fiscal, Administrative, Legal <br />and Miscellaneous <br />Capitalized Interest <br />TOTAL <br />209,160 <br />210,000 <br />$1,581,160 <br />2. This Council's Resolution awarding the sale of the $2,150,000 <br />General Obligation Temporary Improvement Bonds of 1981 is hereby amended to <br />the following extents: <br />(a) The total amount of the bond issued shall be reduced to <br />$1,600,000; <br />
