• Anoka County Contract No. 2009- 0569A2 • • AMENDMENT NO. 2 TO JOINT POWERS AGREEMENT FOR THE RECONSTRUCTION OF COUNTY STATE AID HIGHWAY 14 (MAIN STREET) AND I -35E INTERCHANGE COUNTY PROJECT NO. S.P. 02- 614 -28 THIS AMENDMENT is made and entered into this day of 2012, the date of the signature of the parties notwithstanding, by and between the County of Anoka, a political subdivision of the State of Minnesota, 2100 Third Avenue, Anoka, Minnesota 55303, hereinafter referred to as the "County," and the City of Lino Lakes, 600 Town Center Parkway, Lino Lakes, Minnesota 55014, hereinafter referred to as the "City ". WITNESSETH: WHEREAS, it is mutually agreed upon that the County and the City wish to amend its Joint Powers Agreement for the reconstruction of the Interchange of I -35E and County State Aid Highway 14 (Main Street) including the bridge over I -35E, hereinafter referred to as the "Project "; and, WHEREAS, Section XII. ENTIRE AGREEMENT REQUIREMENT OF A WRITING of said Agreement provides that any alterations, variations or modifications of the provisions of this Agreement shall be valid only when they have been reduced to writing and duly signed by the parties. NOW, THEREFORE, in consideration of the mutual covenants hereinafter stated or contained in the Agreement, the parties do hereby agree as follows: 1. The parties agree to delete Section III, F.4. of Amendment 2009 -0569A in its entirety and replace it with the following: F. The Payment from the City to the County shall be as follows: 4. In lieu of a $300,000 payment for the turnback of County Road 153 (Lilac Drive) from the County to the City, the County will perform a reclaim and overlay on County Road 153 (Lilac Drive). Upon written demand, the City shall return to the County, in full, the previously paid $300,000 within 30 days. This work shall be designed and constructed by the County and completed with the County 2012 Overlay Program, with work to be finished by December 31, 2012.
