Council Meeting 14° <br />February 8, 1982 <br />Mr. Reinert asked if this was the parctice in 1975 to allow construction <br />without the issuance of a special use Permit? <br />IIIMr. Marier asked tor.have the minutes read. The Clerk read the minutes from <br />both the Planning and Zoning Board action and the Council approval of this <br />construction. <br />There was no indication in either minutes that a special permit was <br />requested. <br />Mayer BensOR aske4.that copies of all minutes pertaining to this issue <br />be copied and put in the file. <br />Mayor Benson asked that all documentation on this matter be part of the <br />next Council packet. On voting, the motion carried unanimously. <br />LAKES ADD #7 - CONSIDERATION OF BIDS AND ASSESSMENTS <br />Mayor Benson op•e.ed this hearing at 9;04 P.M. Mr. Winner was asked to <br />review the action to date, <br />Mr.. Winner restated the bids and noted the low bidder had made a clerical <br />error and had asked to either adjust his total_ or to withdraw his bid. <br />Mr. Winner presented the Options open to the Council at this point, noting <br />that these bids are good through March 9th, 1982. Mr. Winner presented <br />some options in the area of establishing the assessment policy. <br />I Council discussed this matter, noting that the trial for the quads is set <br />for Tuesday, March 2, 1982. <br />Mr. Marier moved to table consideration of this matter until there is a <br />Court decision. Seconded by Mr. Reinert. Mayor Benson asked what happens <br />if the bid is not awarded by the 9th of March? Mr. Winner said the bids <br />lapse and the bid bonds are returned. The motion carried with Mrs. <br />Elsenpeter voting, No. <br />Mr. Marier moved to close the hearing at 9:38 P.M. Seconded by Mr. Reinert. <br />Motion carried unanimously. <br />A five minutes recess was called at this point in the meeting. The meeting <br />was reconvened. <br />Mr. Winner reported on the status of the Letters of Credit provided by Mr. <br />Jack Menkveld in conjunction with Carole's Estates I E II and Forest Glen. <br />The Letter of Credit for Forest Glen had been renewed. Mr. Winner noted <br />the status of these developments explaining the remaining construction to <br />be completed in these plats. <br />Mr. Marier moved to require these three plats of Mr. Menkveld's be completed <br />by the end of June, 1982 and if a hardship occurs, the Council would reassess. <br />Seconded by Mr. Reinert. Motion carried unanimously. <br />COMMUNITY DEVELOPMENT GRANT FUNDS <br />Mr. Schumacher reported that the application must be filed by March 1, 1982. <br />Mr. Reinert noted the items that had been presented to the Council for <br />
