Motion carried with Mayor Benson voting, No. <br />The Public Hearing on Federal Revenue Sharing Funds usage was closed at 7:39 P.M. <br />PUBLIC HEARING - SPECIAL USE PERMITS <br />Mayor Benson opened the public hearing on special use permits at 7:39 P.M. He listed <br />the five inactive permits that were to be considered at this hearing. He asked if <br />anyone in the audience had come to speak on any of the permits and there was no one. <br />Mr. Marier moved to revoke the special use permits issued to Richard Carey, Warren Solheid, <br />Sally KeutherJJudy Helm, Robert DuFour and Michael Kelly. Seconded by Mr. Re inert. <br />Motion carried unanimously. <br />i <br />Mr. Kluegel pointed out there are two permits that have had no construction taking place <br />within the one year as specified by the Ordinance - the El Rehbein & Son permit for an <br />additional floor to their office building and A. T. Gearman for a storage building. <br />Mr. Kluegel noted the Special Use Permit #54, issued to El Rehbein & Son, had been <br />issued over 12 months ago and no work has been started as of this date. He had <br />discussed this with Mr. Jerry Blackbird and the delay was due to the economics. <br />Mayor Benson asked for Mr. Kluegel's recommendations and Mr. Kluegel asked <br />Mr. Hawkins what the options were. Mr. Hawkins said the permit could either be <br />revoked or an extension could be granted. <br />Mr. Reinert moved to revoke Special Use Permit #54 issued to El Rehbein & Son. <br />Seconded by Mr. Marier. Motion carried unanimously. <br />Special Use Permit #45, issued to A.T. Gearman for a storage building on Highway 49 <br />also has not been started. Mr. Bill Iway said they could not build due to the high <br />interest - now that interest rates are dropping, he felt construction would begin <br />in the Spring. <br />Mr. Reinert moved to revoke Special Use Permit #45, issued to A.T. Gearman. Seconded <br />by Mr. Marier. Motion carried unanimously. <br />Mr. Kluegel noted that the Special Use Permit issued to Outlots H & K for the Quads <br />does not have any construction as of this date. <br />1 <br />Mayor Benson noted that a letter had been received from the Judge stating that a decision <br />should be received soon on that litigation, and he would suggest any action on this <br />permit be continued until the Court hands down a decision. <br />Mr. Marier moved to extend this special use permit until there is a Court decision. <br />Seconded by Mr. Reinert. Motion carried unanimously. <br />Mr. Reinert asked if Mr. Harold Bisel's location had been inspected and what are the <br />allowed usages under his special use permit? Mr. Kluegel read the stipulations attached <br />to the Special use permit noting that this was to be a small engine repair shop, with <br />no outside storage, no employees and non - transferable. Mr. Reinert noted that this <br />had turned into a retail business with new equipment being sold out of that location. <br />Mr. Marier moved that a letter be sent to Mr. Bisel asking that he appear before the <br />Council and discuss this matter. Seconded by Mr. Reinert. Motion carried unanimously. <br />Mr. Suchy's permit was discussed with Mr. Kluegel saying he has no problems there. <br />Mr. Smeed - does he need a permit under the new animal ordinance?
