286 <br />JANUARY 3, 19 83 <br />Council Meeting <br />January 10, 1983 <br />Mr. Marier moved to approve the minutes as written. Seconded by Mr. Kulaszewicz. <br />Motion carried unanimously. <br />DISBURSEMENTS 12/30/82 <br />Mr. Marier asked about the check to Radio Shack - Mr. Schumacher explained this is <br />part of the new 911 phone system. Mr. Marier moved to approve the disbursements. <br />Seconded by Mr. Reinert. Motion carried unanimously. <br />Disbursements - 1/10/83 <br />There were questions on several of the statements which Mr. Schumacher answered. <br />Mr. Marier moved to approve the disbursements. Seconded by Mr. Kulaszewicz. Motion <br />carried unanimously. Mr. Marier requested that all items that are reimbursable be <br />so noted on the disbursement list. <br />OPEN MIKE <br />Mr. Stephan Adams asked to speak on 'a plumbing situation. He had purchased a permit <br />to hook into the sewer on County Road J, had contracted with a company to do the work <br />and the Building Inspector had stopped the installation because a Deed to the property <br />the sewer line is in has not been signed by the Adams' and Mr. Adams said he had no <br />intentions of signing the Deed. Because of the stop order on the work, the contrac- <br />tor left and had to be recalled another day and consequently, Mr. Adams received an <br />extra bill for $240.00 and an Attorney's fee of $40.00. He wanted the City to pay <br />these bills. <br />Mr. Hawkins gave the Council background information on this action, noting that the <br />signed document has not yet been returned and stating that he felt the City had <br />acted in a responsible manner to insure that this sewer line can be maintained no <br />and in the future. <br />Mr. Hawkins gave the Council background information on this action, noting that the <br />signed document has not yet been returned and stating that he felt the City had <br />acted in a responsible manner to insure that this sewer line can be maintained now <br />and in the future. <br />Mr. Adams said the line is 15' inside his property line and he is not giving up 15' <br />of his property. Mr. Hawkins explained that an easement is only the right of the <br />City to maintain the line, Mr. Adams still owns the property. <br />There was some discussion on the responsibility of this extra cost and Mayor Benson <br />felt that this was the responsibility of their Attorney since he was the one who <br />advised them not to sign the easement. <br />Mr. Reinert felt this is not the place for such a discussion. If Mr. Adams felt <br />this should be the responsibility of the City, then he should present a bill to <br />the City and the Council will take it from there. <br />TELEPHONE CHANGE PROPOSAL <br />This proposal had been presented at an earlier meeting and the Council had questioned <br />the provisions in the budget. The Clerk reported that this cost had been approved in <br />the 1983 budget. After some discussion, Mr. Kulaszewicz moved to approve the <br />
