Council Meeting <br />September 26, 1983 <br />DISBURSEMENTS - September 26, 1983 <br />107 <br />I Mr. Kulaszewicz moved to approve the disbursements as presented. Seconded <br />by Mr. Marier. Motion carried unanimously. <br />1 <br />OPENING OF THE BIDS - BALDWIN LAKE MOBILE HOME COURT PROJECT <br />Mr. Hawkins reported there had been a question raised as to the procedure <br />in awarding the contract. This matter had been discussed with the owner, <br />contractor, C ity Engineer, Mr. Schumacher and Mr. Hawkins. Mr. Hawkins <br />reported that if Juran & Moody has submitted the low bid, Bond Counsel <br />would research the City Charter before they would write an opinion. <br />The question was in reference to the contract amount being over the <br />Engineer's estimated figures by more than 10 %. Mr. Hawkins felt that if <br />the Bank is low, the bid could be awarded since they are not requesting <br />a Bond Councsel opinion. <br />Mayor Benson said, since this entire project is to be assessed against one <br />person, how is this affected by the Charter. If there was nore than one <br />owner involved, then it would be understandable - he did not understand <br />what Mr. Weible meant in his letter. <br />Mr. Hawkins said the section is very poorly worded - he pointed out the <br />contradictions in this section and with some suggestions on how to make <br />the intent more clear. Mr. Hawkins felt the Council had followed the <br />intent of the Charter but in order to eliminate the possible of shutting <br />the project sown, the proposal to reduce the contract by a change order <br />to within the allowable limits had been accepted by the owner and the <br />contractor. Mr. Hawkins felt this is the best way to go at this time in <br />order to avoid more controversy. <br />Mr. Schumacher read the next interest amounts as follows: <br />Juran & Moody - $47,510.00 - net effective rate - 8.638% <br />Hugo State Bank - $47,600.00 - net effective rate - 8.45% <br />The Council members had some questins on the interest - it did not seem <br />correct. Mr. Hawkins suggested a delay in a decision on this matter until <br />later in themeeting in order for these figures to be checked. <br />Mr. Marier moved to table decision on this until later in the meeting to <br />allow time for the figures to be checked. Seconded by Mr. Kulaszewicz. <br />Motion carried unanimously. <br />OPEN MIKE <br />There was to be a Representative from Senator Boschwitz's office present <br />but that person was not present a this time. <br />Mr. Craig Marshall requested the paving of the West 200 feet of Sandpiper <br />Drive. He siad they have to park on the balcktop and walk in and are con- <br />cerned with emergency vehicles being unable to get inot the street. He <br />also wants to improve his driveway and felt that he should wait until <br />the grade of the street is established. <br />Mr. Schumacher asked what typw of surface was there when he bought the <br />lot and Mr. Marshall said this street dead ends at the golf course and <br />
