108 <br />Council Meeting <br />September 26, 1983 <br />he and the County are the only ones that use the street. <br />Mr. Schumacher felt the first step is to determine if the City owns any <br />right -of -way in that area. <br />Mrs. Elsenpeter felt this street was in Mr. Volk's 5 year capital <br />improvement plan and suggested this be checked out also. <br />The matter of the right -of -way and the propsoed improvement will be <br />checked and reported at the next meeting. A copy of the findings will <br />be forwarded to Mr. Marshall. <br />The representative from Senator Boschwitz's office was still not present. <br />PLANNING AND ZONING BOARD ACTIONS - MR. KLUEGEL <br />Mr. Kluegel reported that the Conditional USe Permit application for <br />Mr. Paul Wolters had been presented to the Planning and Zoning and they <br />had recommended approval. However, in order to comply with the new <br />zoning Ordinance, a public hearing must he held. Mr. Kluegel requested <br />the Council to set a public hearing for consideration of this applicaiton. <br />Mr. Schumacher aksed what lever does the City have to insure the com- <br />pliance to the stipulations imposed by the P &Z? Mr. Kluegel said a 1% <br />escrow account must be deposited with the City. <br />Mr. Kulaszewicz moved to set a public hearing on the conditional use <br />permit for October 24, 1983 at 8:00 P.M. Seconded by Mr. Marier. Motion <br />carried unanimously. <br />MR. WILLIAM LAHTI - VARIANCE <br />Mr. Lahti had applied for a variance to the 30' side yard setback re- <br />quirements on a corner lot. The Planning and Zoning had reviewed this <br />request and was concerned with the future development of this side of <br />the strete. They also felt there is enough space on the lot to construct <br />the garage to conform to the required 30' side yard set back requirement <br />ona corner lot. On this basis the Planning and Zoning had recommended <br />this variance be denied. <br />Mrs. Elsenpeter noted that a resident on that street has located his <br />garage facing the proposed side street and is using the unimporved side <br />street for a driveway. She suggested that he might consider this. <br />After much discusison on this matter, Mr. Kulaszewicz moved to deny the <br />variance request. Seconded by Mr. Mraier. On voting on the motion, Mr. <br />Marier and Mr. Kulaszewicz, Aye; Mrs. Elsenpeter - No; Mayoar Benson <br />abstain. The motion failed. <br />Mrs. Elsenpeter moved to send this back to the Planning and Zoning with <br />instructions to find a solution to this problem Seconded by Mr. Marier. <br />Motion carried unanimously. <br />CONDITIONAL USE PERMIT - DOG KENNEL - TODOROFF/TORGESON <br />Mrs. Elsenpeter moved to set a public hearing on this application for <br />October 24, 1983 at 8:30 P.M. Seconded by Mr. Marier. Motion carried <br />unanimously. <br />
