1 <br />1 <br />199 <br />March 26, 1984 <br />ATTORNEY's REPORT <br />The Bingo Permit application for St. Joseph's Church was considered. <br />Mr. Hawkins said the application isin order with the exception of a <br />$10,000.00 Fidelity Bond. <br />Mr. Kulaszewicz moved to approve the Bingo Permit A pplication with the <br />stipulation that the Bond be provided. Seconded by Mr. Bohjanen. <br />Motion carried unanimously. <br />LaMotte. Park Update - Mr. Hawkins reported that this had been dedicated <br />as a park as a part of th eplat and therefore the City does not have the <br />ability to sell this land. <br />Mr. Schumacher suggested this letter be sent to the Planning and Zoning <br />Board and the Park Board. <br />Mr. Marier questioned the portion of the letter dealing with the state- <br />ment that the underlying owner retains the fee title and the City only <br />has an easement for park purposes over this land. <br />Mr. Hawkins pointed out taht even if the City could get a dded from the <br />owners, it would also be necessary to get a deed from the other property <br />owners in LaMotte's Third Addition. <br />Mr. Hawkins said the Park land could be vacated and would then revert <br />back to the original owner. There must be a public hearing and all <br />persons involved must be notified. <br />Mr. Marier felt this idea should be presented to the Park Board and let <br />them decide what should be done. <br />Joint Fire District Agreement - Mr. Hawkins went through the changes that <br />have been done at the last meeting. He went throught these changes and <br />explained the reasoning behind the changes. <br />The Council had some questions on some of the changes which were dis- <br />cussed by Mr. Hawkins. <br />There was a question on the cancellation of the contract with the City <br />of Lexington. Mr. Schumacher r eported he and discussed this with that <br />City and the general consensus was there would be n o problem once this <br />agreement has been approved and a starting date for the new district <br />has been established. This City also has some equity in the equipment <br />owned by the City of Lexington. This will need to be worked out. <br />Mr. Marier moved to approve the Joint Powers Agreement to Establish the <br />Southeast Anoka County Fire Protection District between the Cities of <br />Centerville, Circle Pines, and Lino Lakes with the stipulation that a <br />letter from the City of Lexington agreeing to the cancellation of the <br />existing contract. Seconded by Mr. Kulaszewicz. Motion carried <br />unanimously. <br />Mayor Benson noted this is the culmination of a long four years and he <br />thanked the persons involved in making this a reality. <br />
