204 <br />March 26, 1984 <br />NEGATIVE DECLARATION ON EIS FOR RIACE LAKE ESTATES <br />Mr. Schumacher explained the procedures that must be followed in this <br />type of consideration, noting that on a plat such as this and EAW must <br />be prepared and submitted to approximately 15 different agencies for <br />their comments. This has been done for this plat and the only agency <br />with concerns is the Minnesota Historical Society who requested some <br />additional studies. This is being done by the developer as soon as the <br />snow is gone. <br />Mr. Schumacher said a negative declaration could be made by the Council <br />unless they have received some further information. <br />Mr. Marier moved to declare a negative declaration on requiring an EIS <br />on the Rice Lake Estates with the stipulation that the studies requested <br />by the Minnesota Historical Society be done. Seconded by Mr. <br />Kulaszewicz. Motion carried unanimously. <br />RICE LAKE ESTATES FINAL PLAT <br />Mr. Schumacher presented the list of items that must be done by the <br />developer before the plat can be signed. He went through these items <br />for Council comment. 1) Abstract must be updated; 2) deed to Lot 1, <br />Block 1; Check in the amount of $6,525.00 as Park dedications; 4) pro- <br />visions for entrances with MnDOT; 5) drainage provisions to be widened <br />and an easement provided between 6/7 and 8/9, Lot 4; 6) Developers <br />Agreement for installation of utilities; 7) permits for Corps of <br />Engineers for filling; 8) Restrictive soils permit for low lands; 9) <br />no basement below 887';10) Marshall Ash to replace Mountain Ash in the <br />landscaping plan. <br />There was some discussion on the difference of opinion between the Park <br />Board and the Planning and Zoning Board. The Park Board did not feel <br />that a Tot Lot was necessary in this plat and the Planning and Zoning <br />had recommended the placement of a Tot Lot. <br />Mr. Prokop, of the Planning and Zoning Board, presented the thoughts <br />behind the Planning and Zoning Board's recommendation. <br />Mr. Schumacher reported that the Park Board is aware of the Planning and <br />Zoning Board's concers. Mr. Ken Johnson of the Park Board, had met <br />with the Circle Pines' Park Board to discuss the sharing of Baldwin Park. <br />The developers were asked their Opinion on the Tot Lot and Mr. Schaffer <br />said they had provided for a tot lot per the Planning and Zoning's <br />request and then the park Board had said they didn't need a tot lot so <br />it was removed and they have proceeded on that information. They have <br />no preference either for or against. <br />Mr.Reinert moved to approve the feral Plat of _ -_Rice Lake Estates per the <br />stipulations as outlined by the Administrator and contingent upon the <br />feasibility for the utilities before final signature of the plat. <br />Seconded by Mr. Marier.
