242 <br />June 11, 1984 <br />Mr. Davidson pointed Out that due to a Charter provision, no decision <br />will be made on the project at this meeting. A 60 -day waiting period <br />must elapse before Plans and Specifications may be ordered. Then there <br />must be a three -week advertising period before bids can be opened and <br />tabulated. Mr. Davidson felt that the assessment hearing should be <br />held some time in September in order for the Assessments to be certi- <br />fied to the Council before October 10, 1984. <br />Mr. Davidson completed his presentation and Mayor Benson called a 10- <br />minute break, the meeting reconvened at 8:45 p.m. <br />Mayor Benson asked about the area assessment in addition to the assess- <br />ment. Mr. Davidson said, yes, this seems to be the most equitable <br />method of assessing the overall cost so that the persons who will <br />most use the system pay their fair share. <br />Mayor Benson asked would anyone living in the areas of white on the <br />map, and the sewer goes in front of his property, will that person <br />be forced to hook up and Mr. Davidson said, No, there would not be a <br />connection provided. <br />Mayor Benson asked, if there is sewer in the street, can the owner <br />have a private contractor install to the residence and Mr. Davidson <br />said the service lines are only extended to the property line and it <br />is his responsibility from that point. <br />Several residents of the Lakeview Area had technical and legal questions <br />which Mr. Davidson and Mr. Hawkins answered. Mr. Hawkins pointed out <br />per the requirements in the City Charter, the Council does not have <br />the authority to put in a project over the objections of the residents <br />of the area proposed to be serviced. <br />Mr. Larson, of the finance committee of St. Joe's Church, said the 40 <br />acres the Church owns is for sale, but there had not been a committment <br />as of this date. As of this date, the Church is not interested in the <br />sewer for that land. Mr. Davidson said that acreage could be deleted <br />without affecting the project. <br />Someone asked about the risks and if the City as a whole would not be- <br />come responsible for this assessment in the event of a default by the <br />developers and Mr. Hawkins explained that the City has a developers <br />agreement that requires a 100% Letter of Credit be posted by each <br />developer to cover the assessments If the developer goes bankrupt <br />that has no effect on the Letter of Credit which is issued by a bank. <br />Mayor Benson pointed out that the City Council has been working this <br />project for over a year and felt that all aspects of this project have <br />been considered. He felt that both the developers and the residents <br />of the City has been accommodated. <br />There was some question on who is /who isn't to be assessed and Mr. <br />Marier pointed out that if there is a home on the property at this <br />date, that home will not be assessed for any cost. <br />There was a question as to when the Council will make a decision on <br />this project and it was pointed out that, according to the City Charter <br />1 <br />1 <br />1 <br />
