Council Meeting <br />September 10, 1984 <br />Page Three <br />297 <br />Mr. Harold Bisel, nearby landowner appeared from the audience reporting a <br />Ipast problem with. barking and howling. Mr. Turrey Erickson, future nearby <br />home builder voiced his concern with the potential nuisance and resaleability <br />of his future home. <br />Mr. Johnson explained that he trains his own and customers' dogs in the <br />area, across land belonging to Mr. Cardinal and Mr. Hanson, from whom he <br />has written permission to do so. He also trains in two locations off -site. <br />The Council asked Mr. Johnson several question such as: what would you do <br />ih the case of revoked permission to use Mr. Cardinal and Mr. Hanson's land ?; <br />were you aware that you were in violation of ordinance with over two dogs ?; <br />to which Mr. Johnson answered: I would have to train off -site; I did not <br />know I was in violation until Mr. Bisel's complaint perpetrated my request <br />for a kennel license. <br />Mr. Reinert moved to deny Mr.Johnson's request because the kennel has grown <br />from containing personal pets to a business use. Seconded by Mr. Marier. <br />On voting on the motion, motion failed. <br />Mr. Reinert then moved to grant Mr. Johnson a conditional use permit to allow <br />four dogs of his own, to be reviewed in six months by the building inspector, <br />the kennel be landscaped and screened, which will bring the request into <br />conformity with the ordinance. Motion seconded by Mr. Bohjanen. Motion <br />carried with Mr. Marier voting no. <br />CONSIDERATION OF ORDINANCE 84 -07 - HOME RULE CHARTER AMENDMENTS - 2nd Reading <br />Mr. Reinert moved to dispense with the second reading and adopt ordinance <br />84 -07. Mr. Marier seconded, the motion carried. <br />PUBLIC HEARING - AMENDED CONDITIONAL USE PERMIT - WCCO <br />Mayor Benson opened the public hearing at 8:37 P.M. Mr. Shepard, WCCO Repre- <br />sentative, and Mr. Kluegel presented the request. Mr. Bohjanen asked why <br />WCCO keeps having to amend the conditional use permit. Mr. Shepard explained <br />that the request was for the addition of two receiving antennae dishes which <br />are required die to the fact that the network will be switching to this method <br />of receiving this fall rather than the method currently in operation. He <br />also said that with the growing technology in this field, changes such as <br />this are uncontrollable. <br />Mr. Marier moved to grant the amended conditional use permit based on the <br />recommendations of the Planning and Zoning Board. Motion seconded by Mr. <br />Bohjanen. On voting on the motion, motion carried with Mr. Reinert voting no. <br />ASSESSMENT HEARING - REILING ROAD - RESOLUTION 84 -29 <br />Two interested citizens were present in the audience, to which Mr. Davidson <br />explained the assessment plans for Reiling Road - a term of ten years, 1 /10th <br />f the principal per year, 10% interest on the unpaid balance, first payment <br />due 1/1/85 (due with May /October, 1985 taxes). <br />Mr. Benson asked that Mr. Davidson also present at this time the change <br />order calling for a retaining wall around the Evans property which came <br />about after discovering that the road comes too close to the Evans property. <br />
