1 <br />1 <br />1 <br />COUNCII, MEETING <br />October 22, ]984 <br />Page Four <br />over the LeBlond property for a temporary drainage ditch. Condi- <br />tions on the documents are: <br />1) Temporary easement for one year, the City must effect a <br />permanent drainage plan within one year and /or restore the <br />property to its original condition, <br />2) The easement does consist of .89 acres and fee of $134 for . <br />land and $200 for tree removal, for a total fee of $334 be <br />paid to the owner, <br />3) This temporary easement does not subject the owner to any condi- <br />tions for future permanent easement. The estimated cost is <br />$8,234, about $4,000 is the culvert which is Mr. Nelson's re- <br />sponsibility. The next step would be to meet with Mr. Nelson <br />and determine a method of payment. <br />Mayor Benson asked when the City would be going ahead with a perma- <br />nent plan involving Anoka County. Mr. Davidson said he would urge <br />the City to consider going ahead with a MSA plan for Main. Street and <br />this area immediately. <br />Mayor Benson asked what would happen if the Council does not have <br />a permanent solution to this problem within one year. Mr. Davidson <br />said we would have to renegotiate with Mr. LeBlond. Mr. Schumacher <br />said that if the City has made significant progress to gain a per- <br />manent solution, he thought Mr. LeBlond would extend for another <br />six months. Mr. LeBlond has said he would not object to this as a <br />permanent solution if it were piped. <br />Mr. Reinert felt this document would be too binding on the City. <br />Mayor Benson said sometimes these plans take a long time to com- <br />plete. The general consensus was the language should allow for an <br />extension of the agreement. <br />Mr. Bohjanen moved to have Mr. Hawkins draft the legal document <br />with language that would allow for an extension of the agreement if <br />the City has not completed plans for a permanent solution to the <br />problem in the Sherwood Green area. Conditions 1 - 3 are agreeable <br />if the language does allow for the extension. Mr. Reinert seconded <br />the motion. Motion declared passed. <br />Status Report - District #5 Engineers Meeting MSA Funding - <br />Mr. Davidson explained the state has changed the manner in which <br />storm sewer needs funding is handled. There will be no effect on <br />the amount of funding the municipalities will receive, the funding <br />will be received after construction as a reimbursement. <br />039 <br />
