COUNCIL MEETING <br />Page Three February 11, 1985 <br />CONSIDERATION OF ZACK JOHNSON AS CITY PLANNER <br />IMr. Schumacher had presented an amended proposal from Mr. Zack Johnson <br />with hourly rates adjusted from $65.00 /hr. to $55.00 /hr; flat meeting <br />rate of $95.00 no maximum time limit; phone calls from staff and plann- <br />ing commission members will not be charged for unless they exceed thirty <br />(30) minutes; all out of pocket expenses would not have the multiplier <br />and the City would pay only actual costs. Mr. Kulaszewicz moved to <br />appoint Zack Johnson City Planner for 1985. Mr. Marier seconded the <br />motion. Motion carried unanimously. Mr. Schumacher said that a formal <br />agreement would be prepared and would become effective the date the agree- <br />ment is signed. He also explained the transition from Barton - Aschman <br />should be smooth since Mr. Johnson knows Barton - Aschman very well. <br />ATTORNEYS REPORT <br />Northdale Construction Settlement - The Council at their last meeting <br />authorized Mr. Hawkins to offer $750.00 to Northdale Construction to <br />settle their case against the City. He has since met with them and the <br />final figure is now $800.00. Mr. Kulaszewicz moved to settle with North - <br />dale Construction for $800.00. Mr. Bohjanen seconded the motion. Motion <br />carried unanimously. <br />Status Report - Robert Wilson Case - The City, Ulmer Construction and <br />the previous City Engineer was sued by Mr. Wilson because of a drainage <br />roblem. The insurance company was defending the City and the case was <br />appealed all the way to the State Supreme Court. The matter was sent <br />ack down to district court with instructions that the plaintiff had <br />the right to amend his pleadings against the City to allege inverse con- <br />demnation. The City is denying all allegations. Mr. Wilson did serve <br />these pleadings on the City, there was a court hearing February 4, 1985 <br />and the Court did allow him to amend his pleadings. The City has 20 <br />days to respond. Because there is no money damages claimed by Mr. Wilson, <br />the insurance company is out of the case and the City is now obligated <br />to defend itself. Mr. Hawkins will be putting an answer into the complaint <br />denying the City has done anything illegal. He is still hopeful Mr. Wilson <br />will sell the property for development. <br />NEW BUSINESS <br />A. Revenue Sharing - Mr. Schumacher has received an Action Alert from <br />the League of Cities regarding the President's proposal to eliminate <br />Federal Revenue Sharing entirely. This would mean about a $43,000 reduct- <br />ion in the City budget for 1986. <br />Mr. Marier moved to send a letter to our members of congress and our <br />senators under the signatures of the Mayor, City Council and Administ- <br />rator in support of the General Federal Revenue Sharing through 1986 and <br />beyond. Mr. Kulaszewicz seconded the motion. Motion carried unanimously. <br />I . Tax Estimates - Mr. Schumacher presented a schedule of 1984 and 1985 <br />axes payable and noted that in some areas taxes have gone down 35%. <br />his is a result of some effort on the part of the City Council and <br />the school district to reduce taxes. <br />Mr. Reinert thanked the Forest Lake Times for their nice editorial. <br />
