1 <br />1 <br />033 <br />COUNCIL MEETING <br />June 24, 1985 <br />Page Seven <br />Mr. Davidson has reviewed the city water system with Mr. Volk and <br />Mr. Schumacher and has obtained the information necessary to per- <br />form a study for improvement of the system. The present facility <br />is becoming inadequate because of the rapid growth in the area. <br />ATTORNEYS REPORT <br />A. Liquor License Renewals - The annual liquor license renewal <br />is due July 1,1985 and applications, bonds and certificate of <br />insurance have been received. Mr. Hawkins said all were in <br />order with the exception of Lee's of Lino who have not yet <br />provided a Certificate of Insurance. He recommended the <br />Council approve the licenses with the approval of Lee's of <br />Lino to be contingent on their providing a Certificate of In- <br />surance before July 1, 1985. <br />Mr. Marier moved to approve Mr. Hawkins recommendations. Mr. <br />Kulaszewicz seconded the motion. Motion carried unanimously. <br />B. St. Joseph Catholic Church Request for Beer Permit - This request <br />is for a 3.2 Beer on -Sale Permit for their annual Summer Festival <br />August 10, 11, 1985. Mr. Hawkins said it appears to be in order <br />and recommended approval. <br />Mr. Bohjanen moved to approve this request. Mr. Kulaszewicz <br />seconded the motion. Motion carried unanimously. <br />C. Roland Ford Court Decision - There will be a court hearing on <br />June 26, 1985 and the City will be able to give input as to how <br />the property should be fenced. Mr. Kluegel will be at the hearing <br />representing the City. <br />Mr. Schumacher noted the court memorandum calls for screening <br />by a six foot fence along the south, east and north sides of <br />the property on an eight foot fence along the highway. The eight <br />foot fence violates, City Code. Mr. Hawkins said the purpose of <br />the hearing is to iron out all the details. <br />D. Robert Wilson Case - Mr. Hawkins updated the Council on this <br />matter. The insurance company has been representing the City <br />until recently. The matter has gone to the Supreme Court and <br />this court has said Mr. Wilson should have plead his case to be <br />one of inverse condemnation which is an action to require the <br />City to acquire the property. It was remonded back to the Dis- <br />trict Court and the City started an action against Milner Corley <br />who was the City Engineer at that time. Milner Corley moved <br />to have the case against them dismissed and this is currently <br />under advisement by the Court. The main action of whether or not <br />
