There has bee <br />talk of selling the property and this may resolve the problem. <br />He will keep the Council updated. <br />The Council took a five minute break at 8:22 P.M. <br />PLANNING AND ZONING REPORT - PETE KLUEGEL <br />A. Alwin LaMotte - Mining Report - Conditional Use Permit Flood Plain. <br />Mr. Kluegel explained this request is for a Mining Permit for <br />1000 cubic yards of fill and a Conditional Use Permit to take fill <br />out of a,flood plain area. A Rice Creek Watershed permit has been <br />issued to construct two duck ponds and take the residue off the <br />site. Mr. Kluegel explained that this is an after the fact permit. <br />He had received a copy of a citation sent to Mr. LaMotte by the <br />RCWD instructing Mr. LaMotte to remove the fill from a certain <br />elevation. He had contacted Mr. LaMotte and found the fill was <br />being removed. <br />Mr. Kluegel explained a Mining Permit is $100.00 and there is no <br />restoration fee required in this case. The Planning and Zoning <br />Board has instructed that when Mr. LaMotte comes back for per- <br />mission to dredge county ditch #25 he not be double charged. The <br />single fee of $100.00 will cover both instances. <br />Mr. Marier moved to grant Alwin LaMotte at 6510 - 12th Avenue <br />a Mining Permit to remove spoils from the land described in the <br />application and also that any monies be reimbursed back to him <br />for double payment as recommended by the Planning and Zoning <br />Board. Mr. Kulaszewicz seconded the motion. Motion carried un- <br />animously. <br />The Flood Plain Ordinance requires a Conditional Use Permit <br />to remove spoils out of a flood plain. Mr. Kulaszewicz moved <br />to approve the Conditional Use Permit to remove 1,000 cubic yards <br />of dredged material out of the area described in the application. <br />Mr. Reinert seconded the motion. Motion carried unanimously. <br />B. Russell Pert - Clarifying Definition of Household Pet. Mr. Klue- <br />gel explained a police officer responded to a complaint of a goat <br />being kept on residential property. The property is zoned Ex- <br />pansion Residential and consists of approximately 1.8 acres. The <br />Animal Ordinance was reviewed and found that the definition of <br />household pets does not involve goats. Therefore a request for <br />a variance was taken to the Planning and Zoning Board because to <br />keep large animals in this area requires a five acre lot. The <br />Planning and Zoning Board reviewed the Animal Ordinance and found <br />this animal would fall under the household pet category based on <br />these key words "similar animals" and "kept as household pets." <br />Zack Johnson, City Planner, brought to the attention of the <br />
