1 <br />1 <br />035 <br />COUNCIL MEETING <br />June 24, 1985 <br />Page Nine <br />Planning and Zoning Board that the intent of the Ordinance with <br />the respect to farm animals was not to allow large concentration <br />of farm animals on small lots. The Planning and Zoning Board <br />did recommend that the applicant be reimbursed the variance fee. <br />Mr. Kulaszewicz moved to approve the.recommendation of the Plann- <br />-ing`and Zoning Board including return-the variance fee and not <br />proceed on the warning ticket. Mr. Bohjanen seconded the motion. <br />Mr. Reinert asked if the goat was kept in the house. Mrs. Pert <br />explained., when the family is not home it is kept in a kennel, <br />otherwise it is kept as a dog and it is housebroken and does come <br />into the house. It is not used for milking or like a farm animal. <br />Mr. Reinert felt this was an unusual situation and wondered where <br />this would stop. On the motion, motion carried unanimously. <br />C. Russell Rehbein - Variance - Conditional Use Permit - Arena - <br />Mr. Kluegel explained this is a request for an arena in the Rural <br />area on five acres of land. The plan is to build a home, a horse <br />barn and an arena of 12,440 squ -are feet. A variance is required <br />because the size of the arena exceeds the size of accessory <br />buildings allowed by the Zoning Ordinance on five acres. A Con - <br />ditional Use Permit is required for a horse arena. The Planning <br />and Zoning Board recommended denial of the request for the var- <br />iance for the following reasons: it did not conform to the Ac- <br />cessory Building Ordinance and hardship was not proved as a con- <br />dition for approving the variance. The Planning and Zoning Board <br />recommended approval of the Conditional Use Permit with the fol- <br />lowing stipulations: 1) the arena be built in accordance with <br />the ordinance in respect to size, 2) no horse sales to take place <br />on the property, 3) the arena not be used as a home occupation. <br />The Planning and Zoning Board had a vote on the Conditional Use <br />Permit recommendation. <br />Mr. Jeff Joyer represented Mr. Rehbein and gave further informa- <br />tion regarding the request. He showed the Council a plot plan <br />and a sketch of the home. He felt the Planning and Zoning Board <br />had been inconsistent in allowing the Conditional Use Permit for <br />an arena - but - limiting its size. The arena is for personal use <br />only in exercising and training show horses. There is natural <br />screening on three sides of the properties and to the south there <br />are two residents who also maintain horses. <br />Mr. Reinert asked how many acres would be required to maintain a <br />building the size of the proposed arena. Mr-Kluegel said twenty <br />acres. Mr. Joyer said they are trying to purchase an additional <br />five acres adjoining the property but this is still less than the <br />required twenty acres. <br />Mr. Reinert said even though this could be a good situation to- <br />day the land could be sold and the new owners could request ad- <br />ditional uses because the building is there to accommodate it. <br />
