10.7:5 <br />COUNCIL MEETING <br />August 26, 1985 <br />Page Three <br />Mr. Kulaszewicz moved to approve the metes and bounds <br />conveyance to Mr. Bailey because it meets the require- <br />ments of the City Code as pointed out by the Planning <br />and Zoning Board. Mr. Bohjanen seconded the motion. <br />Mayor Benson asked if this subdivision would be subject <br />to park dedication. Mr. Hawkins suggested this be <br />collected at the time division is approved. Mr. Reinert <br />asked that a procedure be established so that all subdivisions <br />would be treated in the same manner as far as collecting <br />park dedication fees. <br />Mr. Marier moved to amend Mr. Kulaszewicz's motion <br />to include that park dedication requirements be fulfilled. <br />Mr.Reinert seconded the motion. Motion carried unanimously. <br />On voting on Mr. Kulaszewicz's motion, motion carried <br />unanimously. <br />Mr. Schumacher suggested the ordinance should be amended <br />to include the procedure for park dedication. <br />C. Robert Knabe - Metes and Bounds Conveyance, Variance <br />to Lot Width and Platting Ordinance - Mr. Kluegel explained <br />this is a request from Mrs. Helen Rykl for conveyance <br />of a parcel of land containing ten (10) acres with <br />330 feet of road frontage to Mr. Knabe and a request <br />to waive the platting requirement. This parcel is <br />in the rural zone and the Planning and Zoning Board <br />did recommend approval since this request does comply <br />with the Comprehensive Land Use Plan and all other <br />subdivision requirements. <br />Mr. Hawkins explained the platting ordinance does contain <br />a provision for the Council to waive the platting require- <br />ment if compliance will create an unnecessary hardship <br />and if the request complies with the purpose of the <br />subdivision regulations. If the Council waives the <br />platting requirement, a variance will not be required. <br />Mr. Marier moved to approve the request for waiving <br />the platting requirement and approve the request for <br />a metes and bounds conveyance to Robert Knabe. Mr. <br />Kulaszewicz seconded the motion. Motion carried unani- <br />mously. Mayor Benson asked why there were two dissenting <br />votes on the Planning and Zoning Board. Mr. Kluegel <br />felt they did not understand the waiver of platting <br />portion of the ordinance. <br />1 <br />
