092 <br />COUNCIL MEETING <br />September 9, 1985 <br />Page Six <br />County Ditch #22 and to participate in any upgrading and improve- <br />ments in the project as well as share in the costs of the improve- <br />ments. Mr. Hawkins told the Council that the attorney for the Rice <br />Creek Watershed District had written a letter requesting the City <br />follow all the statutory requirements to get the ditch improved. <br />There has been a new lengthly and complicated statute enacted by <br />the state. Mr. Hawkins said he needed to go over the statute with <br />John Davidson, especially the statute language in regard to what <br />an improvement is and what a repair is as well as the requirements <br />of the statutes. He will return to the Council with this informa- <br />tion for further discussion. <br />CLERKS REPORT <br />A. Tax Forfeit Lands - The Clerk explained there are two separate <br />areas of tax forfeit lands. One area is in the Sunset Oaks Subdi- <br />vision and the second area is in the Lakes Addition #2 and #3 areas. <br />The County Auditor has prepared applications for conveyance of these <br />tax forfeit properties to the City of Lino Lakes and the Clerk is <br />requesting permission to sign the applications. <br />The lands in Sunset Oaks contain a City Park, ponding areas and <br />right -of -way for future streets. Mr. Kulaszewicz moved to approve <br />the Clerks request to sign the conveyance documents. Mr. Reinert <br />seconded the motion. Motion carried unanimously. <br />The land in Lakes Addition #3 is Outlot F. This lot can be obtained <br />and used for open space. The City would be responsible for main- <br />taining the area and be liable for injury or anything of that na- <br />ture. The City could also try to divide the property and deed it <br />to the adjoining landowners. This process could be expensive and <br />an adjacent landowner could determine he did not want the property <br />and he could not be forced to accept it. <br />Mayor Benson asked that the adjacent landowners be contacted by <br />letter and determine if they would be interested in obtaining a <br />portion of the property or collectively obtaining the property and <br />maintaining it. <br />The lands in Lakes Addition #2 are four lots on Captains Place. <br />Municipal water and sewer are already installed and the installa- <br />tion was paid for by the developer. There are no assessments on <br />these lots. Mr. Marier moved to acquire Lots 6, 7, 8, and 9, Block <br />5, Lakes Addition #2. Mr. Kulaszewicz seconded the motion. Motion <br />carried unanimously. <br />B. Lino Lakes Zip Code and Drop Off Station - The Clerk explained <br />that several years ago some area citizens started action to obtain <br />a postal drop off station in Lino Lakes as well as an individual zip <br />code number. Previous Councils were aware of the action but there <br />has never been official approval. She also explained some of the <br />difficulty some area residents had encountered. <br />
