?92 <br />Council Meeting <br />January 24, 1983 <br />Mr. Reinert asked for a clarification of the material to be requested from the <br />Planning and Zoning. Mr. Marier said a reassessment of the moratorium, the <br />necessity of splitting those lots and how the Ordinance requiring one acre lots <br />can be protected. <br />Mr. Hawkins said if there is something unique about this parcel then it could be <br />granted but if there is nothing unusual about the lot, then how can this be justified. <br />Mayor Benson suggested that Mr. Hawkins attend that Planning and Zoning Board meeting <br />in order to present the Council's concerns. <br />LeRoux - Variance to Ord. #85. Mr. Bartholdi appeared to represent Mr. LeRoux. <br />He presented history of this land and noted the reasons for the request. This land <br />is located to the South of 64th Street off Otter Lake Road. This involves several <br />pieces of land of various sizes. There are four parcels of land - two with deeds <br />recorded and two that are unrecorded. The request is to combine these four parcels <br />into two parcels. <br />After some discussion, Mr. Reinert moved to grant the variance in order to clear up <br />this situation and the recommendations of the Engineer be followed. Mr. Hawkins <br />added that the lots will be combined and that there were existing contracts before <br />the moratorium was passed. Seconded by Mr. Marier. Motion carried unanimously. <br />Mr. Bartholdi requested that a portion of Mr. LeRoux's fees be refunded since he <br />has paid in 1980 and in 1982. He said he had come to register the deed in 1980 <br />and had been refused. Mr. Hawkins pointed out that the law had not been written <br />in 1980 and the County would have recorded and deed. <br />Mrs. Elsenpeter moved to have Mr. Schumacher check into the history of the payments <br />and costs and report back to the Council. Seconded by Mr. Reinert. Motion carried <br />unanimous ly . <br />A recess was called at 8:15 P.M. The meeting reconvened at 8:25 P.M. <br />ATTORNEY's REPORT <br />Mr. Hawkins had no report. <br />LINO LAKES /CIRCLE PINES BUILDING OFFICIAL's CONTRACT <br />Mr. Hawkins reported on this agreement that he had drafted. This had been modified <br />by the Circle Pines' Council. This provides for this service to be provided for a <br />fee of $14,500.00 for the year 1983. Circle Pines had added a portion that allows <br />that City to renegotiate this figure if the building permits are not up to what they <br />expect. The inspector would be paid 65% of the permit fee if any category of <br />construction was exceeded per the contract. <br />Mr. Marier had a question on the fact that Circle Pines would not be liable for any <br />accident to Lino Lakes' employees while working in their City. Mr. Hawkins explained <br />this. <br />Mr. Reinert felt that this amount had been taken into consideration at budget time <br />and he wondered how this could affect the budget. <br />Mr. Marier moved to approve the contract as originally written with the stipulation <br />that cost figure be $14,500.00 and if Circle Pines has a hardship that they come <br />before the Council and present the hardship. Seconded by Mr. Reinert. <br />
