August 27, 1979 <br />3 <br />of the City's program and charge back to Mr. LaBuda, or 3) Mr. LaBuda can <br />order it done and pay the costs. <br />Mr. Zelinka moved that such improvements as listed in the notice published <br />on July 12, 1979 is hereby ordered. The City Engineer shall supervise <br />the installation. The cost per Schifsky's bid of $3850.00 to Mr. LaBuda <br />shall be spread over a five year period puls 8% interest per annum and if <br />unpaid by October 10th in any given year, shall be certified to the County <br />Auditor. Mr. LaBuda's cost shall be arrived at by deducting the Mattson <br />money in escrow C.D. This action to satisfy the LaBuda and Mattson <br />obligation relative to Deer Pass Trail. Mr. and Mrs. LaBuda agreed this <br />was acceptable. Seconded by Mr. McLean. Motion declared passed. <br />Mr. Roy Mattson is to be notified of this action. <br />Mr. McLean moved to close the hearing at 9:20 P.M. Seconded by Mr. Zelinka. <br />Motion declared passed. <br />The hearing on the rezoning request of Mr. and Mrs. John Bruner was called <br />to order at 9:21 P.M. Mr. Locher read the new publication in relations <br />to thei rezone and the list of mailed notices. <br />Mr. McLean reported that at the Planning and Zoning Board meeting held <br />on August 15, 1979, that Board had recommended approval of this rezoning. <br />There was some discussion of the need for separate septic systems and <br />wells if the building is used as a duplex. Mr. Gotwald said, if there <br />are two owners, then two systems become necessary - with one owner, one <br />system is sufficient. <br />Mayor Karth reminded Mr. Bruner, that if and when, this building is used <br />as a duplex, it must conform to the State Building Code rules in effect <br />at that time. <br />Mr. Zelinka asked about any lesser use permitted in a commercial zone <br />and Mr. Locher said the Ordinance does not allow or disallow, but lesser <br />uses have been allowed in the strip zoning. <br />Two petitions have been received in connection with this rezoning request - <br />one with 5 signatures against and one with approximately 20 signatures - <br />not objecting. <br />Mr. Kulaszewicz had to leave at 9:50 P.M. There can be no vore on this <br />rezone without at least four members present. Mr. Zelinka moved to con- <br />tinue this hearing until September 10, 1979 at 8:10 P.M. Seconded by Mr. <br />McLean. Motion declared passed. <br />Mr. McLean presented the actions of the Planning and Zoning Board: <br />..The request for a special use permit by Mr. Rivard had been tabled for <br />more information. <br />..Mr. Tim Rehbine had requested rezoning frorp R -1 to R -2 on Lots 4,5,6,8, <br />Block 1, and Lot 8 Block '2 in Calole's Estates. There was some discussion <br />on the use of these lots for R1 if they are rezoned to R2. Mor Locher <br />pointed out that Ord. #56 allows R1 in an R2 Zone. Mr. McLean moved to <br />set a public hearing on this rezoning request for September 10, 1979 at <br />9:30 F.M. Seconded by Mr. Zelinka. Motion declared passed. <br />..Mr. Weiglightner had applied for a kennel license for breeding and <br />selling dogs. This is a hobby kennel and not intended for the boarding <br />and keeping of other persons dogs. <br />
