4 <br />August 27, 1979 <br />There was discussion on the requirement in Ordinance No. 37, that only <br />allows kennels in a commercial zone. Mr. Locher said this Ordinance can <br />be amended by Resolution. <br />Mr. Zelinka moved to delete from Ordinance #37, Section 9, the following <br />words, "Only on lands zoned as commercial ". Seconded by Mr. McLean. <br />Motion declared passed. <br />Mr. Zelinka moved to authorize the publication of this Resolution. <br />Seconded by Mr. McLean. Motion declared passed <br />Mr. McLean moved to grant a special use permit to Mr. Weglightner to <br />maintain a hobby kennel with the stipulation that no more than 12 dogs <br />be kept except for puppies under 6 months of age, with an annual re- <br />newable basis from the date of issuance. Seconded by Mr. Zelinka. <br />Motion declared passed. <br />..Mr. Nadeau's East Birch Addition had been considered at the Board <br />meeting. There had been some suggestions on the right -of -way require- <br />ments of the County. The Board had recommended this alnd not be truned <br />over to the County, but additional setbacks be required by the City on <br />these County roads to insure sufficient setbacks when the land is ac- <br />quired by the County through condemnation.. The Council agreed to this <br />concept. The Clerk was instructed to contact Mrs. Pracher, in Centerville, <br />for that City's reaction. <br />The matter of the park requirement was discussed. land - money - or a <br />fully developed park. Mr. Nadeau had wanted to contribute money - the <br />Park Board had requested lands. This matter will be discussed at the <br />public hea =ring. <br />Mr. McLean moved to set a public hearing on the East Birch Addition at <br />8:30 P.M. on September 24, 1979. Seconded by Mr. Zelinka. Motion <br />declared passed. <br />Schilling had presented two preliminary plats - one for an industrial <br />park and one for residential. Action had been deferred on both - more <br />information is needed. <br />On considering Bloom's Addition, the Planning adn Zoning Board had <br />recommended approval of this palt. Mr. McLean moved to set a public <br />hearing on Bloom's Addition at 9:00 P.M. on September 24, 1979. Seconded <br />by Mr. Zelinka. Motion declared passed. <br />On the matter of the Lyndal Nelson problem of a house being too close to <br />a lot line on Lilac Street, Mr. Mobley's letter advising Mr. Nelson to <br />acquire additional property from his neighbor was read. No action was <br />taken. <br />Mr. Fran Burque's Addition was tabled. It was felt Mr. Burque should be <br />billed for the park land monies. Mr. McLean moved that no more parcels <br />of land be accepted for meets and bounds splits in this area. Seconded <br />by Mr. Zelinka. Motion declared passed. <br />The Clerk was instructed to write a letter to Mr. Burque informing him <br />that if nothing is done within 30 days on his plat, his $140.00 filing <br />fee will be forfeit and it may be necessary for him to re- submit and pay <br />the platting fee for a second time. <br />Mr. Zelinka presented some i:te'ms from the Park Board.
