4 August 27, 1979 There was discussion on the requirement in Ordinance No. 37, that only allows kennels in a commercial zone. Mr. Locher said this Ordinance can be amended by Resolution. Mr. Zelinka moved to delete from Ordinance #37, Section 9, the following words, "Only on lands zoned as commercial ". Seconded by Mr. McLean. Motion declared passed. Mr. Zelinka moved to authorize the publication of this Resolution. Seconded by Mr. McLean. Motion declared passed Mr. McLean moved to grant a special use permit to Mr. Weglightner to maintain a hobby kennel with the stipulation that no more than 12 dogs be kept except for puppies under 6 months of age, with an annual re- newable basis from the date of issuance. Seconded by Mr. Zelinka. Motion declared passed. ..Mr. Nadeau's East Birch Addition had been considered at the Board meeting. There had been some suggestions on the right -of -way require- ments of the County. The Board had recommended this alnd not be truned over to the County, but additional setbacks be required by the City on these County roads to insure sufficient setbacks when the land is ac- quired by the County through condemnation.. The Council agreed to this concept. The Clerk was instructed to contact Mrs. Pracher, in Centerville, for that City's reaction. The matter of the park requirement was discussed. land - money - or a fully developed park. Mr. Nadeau had wanted to contribute money - the Park Board had requested lands. This matter will be discussed at the public hea =ring. Mr. McLean moved to set a public hearing on the East Birch Addition at 8:30 P.M. on September 24, 1979. Seconded by Mr. Zelinka. Motion declared passed. Schilling had presented two preliminary plats - one for an industrial park and one for residential. Action had been deferred on both - more information is needed. On considering Bloom's Addition, the Planning adn Zoning Board had recommended approval of this palt. Mr. McLean moved to set a public hearing on Bloom's Addition at 9:00 P.M. on September 24, 1979. Seconded by Mr. Zelinka. Motion declared passed. On the matter of the Lyndal Nelson problem of a house being too close to a lot line on Lilac Street, Mr. Mobley's letter advising Mr. Nelson to acquire additional property from his neighbor was read. No action was taken. Mr. Fran Burque's Addition was tabled. It was felt Mr. Burque should be billed for the park land monies. Mr. McLean moved that no more parcels of land be accepted for meets and bounds splits in this area. Seconded by Mr. Zelinka. Motion declared passed. The Clerk was instructed to write a letter to Mr. Burque informing him that if nothing is done within 30 days on his plat, his $140.00 filing fee will be forfeit and it may be necessary for him to re- submit and pay the platting fee for a second time.
