46 <br />December 26, 1979 <br />Mr, Gotwald was questio -ed of what the Engineering Study would contain and <br />he said this would include the ponding area being constructed according to <br />the recommendations of the Rice Creek Watershed Board and this would im- <br />prove the water quality going to the Lake due to the weir system and the <br />skimmers eliminating the pesticides and fertilizers. There should be <br />detailed elevations based on borings taken within the next month. This <br />would establish minimum elevations for this area and dictate the style <br />of home that could be built in the area, Mr, Gotwald felt the pond should <br />be done before the first house is constructed. <br />It was generally felt this Council could approve this preliminary plat <br />subject to the developer complying with the stipulations as set forth by <br />the Rice Creek Watershed Board and Mr. Gotwlad and it doesn't imply <br />approval of the final plat. <br />There was some discussion on the possibility of this land being split <br />into 2 acre parcels and sold by meets and bounds which would take away <br />any possibility of controls by the City. <br />Mr. Zelinka asked Mr, Gotwald to put these points in writing for the <br />Council with a copy to go to the developer, Mr. Kulaszewicz agreed with <br />this concept. <br />Mr. Gotwald pointed out this would only release the lots facing 77th Street <br />and,Peltier - the streets must be constructed before the interior lots <br />could be released. He also felt that perhsps the City should insist that <br />the streets be constructed before any building permits are released. <br />It was suggested this Council could give approval of the preliminary plat <br />with a developers agreemetn drafted by Mr.Locher and Mr, Gotwlad to be- <br />come a part of the plat and be filed as such. <br />Mr. Zelinka moved to grant preliminary approval of this plat as understood <br />and subject to further planning and conditions to be presented at the con- <br />tinued hearing shceduled for January 14, 1980, with teh Engineer's and <br />Attorney's stipulations to be put in writing and all petitioners to be <br />notified of this hearing, also all other interested parties. Seconded by <br />Mr. Kulaszewicz. Motion declared passed. <br />Mr. Schumacher presented his report on the investment of the funds from the <br />sale of the Improvement Bonds. Mr. Zelinka moved to approve the investment <br />schedule as presented. Seconded by MR. McLean. Motion declared passed. <br />Mr. Schumacher presented a list of investment firms and he asked this be <br />approved for his use, that he be authorized to sgin all collateral agree - <br />ments and to engage in investment agreements, with all actions to be re- <br />viewed by Council. The investment list be documented at 12- 26 -79. Mr, <br />Schneider moved to approve these requests. Seconded by Mr. Zelinka. <br />Motion declared passed. <br />Mr. Schumacher presented specifications for a twoing contract and requested <br />permission to prepare these specs for advertising. Mr. Zelinkanoved to <br />approve this request, Seconded by Mr. Zelinka, Motion declared passed, <br />Mr. Gotwald had prepared letters of recommendations for the acceptance of <br />strees in several plats. Mr. McLean moved to accept the streets in School <br />Subdivision. Seconded by Mr.Sshneider. Motion declared passed. Mr. <br />Kulaszewicz moved to accept the streets in Sunset Estates. Seconded by <br />Mr. McLean. Motion declared passed. Mr. Kulaszewicz moved to accept the <br />streets in Equity Estates. Seconded by Mr„ McLean, Motion declared passed <br />With Mr, Karth abstaining <br />
