86 <br />April 28, 1980 <br />Mayor Gourley noted, that since the road lies entirely within the right -of- <br />way, why is it the City's responsibilty to move it. He felt this should be <br />reconized by this City and if and when improvements are made, they should <br />be on the South side of the road. <br />There was discussion on the number of lots in the new plat that faces onto <br />77th street. It was determined there are only 9 lots facing onto this street. <br />It was the general opinion of the Council that the Street will need some up- <br />grading, the costs to be shared. <br />Mr. McLean suggested that Mr. Volk discuss this matter with Mr. Locher when <br />he plans the upgrading in order to bring this into a more proper alignment. <br />This will have to be put in the capital improvement program for future con- <br />sideration. Mr. Locher pointed out that this Council is not bound by previous <br />Council's actions. <br />Mr. McLean moved that 77th street be a priority item to be considered in the <br />road improvement planning and the road within the right -of -way be looked at <br />with the possibility of centering as previous Councils had attempted to do. <br />Seconded by Mr. Kulaszewicz. <br />Mr. Marier asked, that rather than considering this matter, he would request <br />that some action be taken on this matter within a specific time. Mr. McLean <br />told him this would be decided at budget time. <br />Mayor Gourley called for the vote and the motion carried unanimously. <br />The next item on Mr. Locher report was the matter of Mr. Jeffrey Kirschbaum. <br />Mr. Kirschbaum has accepted the check for $500.00 as severance pay and has <br />signed an agreement to tht effect. <br />Mr. Jaworski moved to accept the resignation of Mr. Jeffrey Kirschbaum. <br />Seconded by Mrs. Elsenpeter. Motion carried unanimously. <br />Mayor Gourley asked for authorization to sign the agreement document. Mrs. <br />Elsenpeter moved to authorize Mayor Gourley's signature. Seconded by Mr. <br />Kulaszewicz. Motion carried unanimous *. <br />Mayor Gourley asked fot- the Engineer's Report on the status of the Black Duck <br />project. Mr. Meisner reported that the project is on schedule. He also <br />reported that Rice Creek Watershed Board is requesting a permit for the <br />existing well and a permit for the culvert going under the street. Also, a <br />permit application for the amoung of fill that has been put into some of the <br />areas. <br />Mayor Gourley asked if the Rice Creek Watershed Board can come in and make <br />this sort of request after the fact and Mr. Locher said they feel they can. <br />Mayor Gourley said the City has entered into a contract and issued bonds for <br />the construction of this project- if some of the lots are not allowed fill, <br />is the Rice Creek Watershed Board picking up the assessments on those lots? <br />Mayor Gourley requested Mr. Schumacher to contact these people and open some <br />negoiations to solve this matter. <br />
