Mayor Gourley pointed out <br />the ordinances that this usage violates. <br />Mr. Kulaszewicz's motion dies for lack of a second. Mr. Jaworski moved to s. <br />deny the special use permit on the grounds that this does not comply to the. <br />Ordninace requirements for land use Seconded by Mr. McLean. Motion <br />carried unanimously. <br />Mrs. Goodale asked if this decision could be appealed. Mr. Locher checked <br />this . <br />Mr. Schumacher reported on the Rite -way request for rezoning the lands be- <br />yond the 300' from Ag /Res to LI. A public hearing must be set on this matter. <br />Mr. McLean moved to set a public hearing for Rite -Way for May 27, 1980 at <br />9:00 p.m. Seconded by Mr. Kulaszewicz. Motion carried unanimously. <br />The next item was a preliminary plat known as Schunemann's Corners. Mr. <br />Schumacher reported on this plat. Located near the corner of Ware Road <br />and 62nd. street. This plat contains 4 lots with a proposed cul -de -sac. The <br />Planner suggested that future street easements be included in the plat in <br />order to allow for an orderly splitting of these Tots when sewer becomes <br />available. The Planning and Zoning Board had also recommended money in leiu <br />of land for Park purposes. There is a nine foot strip on the South that is <br />being sold to the existing home. <br />Mr. Schumacher pointed out the recommendation of the planner for the future <br />streets. There was discussion on this and how it could be accomplished in <br />this plat. Mayor Gourley asked this be redesinged showing the future lay- <br />out of this plat. The matter of the power line easement was discussed - <br />this would affect the setbacks on those front lots. This has been taken into <br />consideration. <br />Mr. McLean moved to table this plat for redesinging. Seconded by Mr. <br />Kulaszewicz. Motion carried unanimously. <br />The next item was consideration of a side yard set back variance request by <br />Mr. Tim Rehbine. This is concerned with a home on Knoll Drive where the house <br />was constructed too close to the adjoining lot line. This is the second <br />request for this variance. Mr. Schumacher said the adjoining property owner <br />is willing to sell the needed property. Mr. McLean moved to deny the variance <br />and instruct Mr.-Rehbine to contact the adjoining property owner for the pur- <br />chase of the necessary footage to meet the City codes. Seconded by Mrs. <br />Elsenpeter. Motion carried unanimously. <br />Mr. Locher reported that a repeal for a special use permit may not be re <br />submitted for one year. <br />Mr. Michael Kenny's request for a special use permit for the operation of- <br />a shop for floral arrangements. The buiIdiing is located on Hodgeson Road <br />within the commercial zone. Mr. Jaworski moved to approve this request. <br />Seconded by Mr. Kulaszewicz. Mr. Schumacher reported that the Planning and <br />zoning Board has recommended approval of this with the request that a dust <br />free driveway be installed.
