000104 <br />Council Minutes <br />May 27, 1980 <br />Mayor, Gourley amended the motion to have the developer provide this dis- <br />cription for the Attorney. This was accepted. Motion carried unanimously. <br />Mr. Kulaszewicz moved to close the Public Hearing. Seconded by Mr. McLean. <br />Motion carried unanimously. 9:20 P.M. <br />On considering the Restrictive Ordinance, Mr. Locher reported that he had <br />problems in locating the exact State Statute. The Ordinance is not ready <br />for consideration at this meeting but is to be on the June 9, 1980 agenda. <br />The next item was the ponding areas in Sunset Oaks and there are some dis- <br />crepancies. There are some ponding areas that are not included. This matter <br />was discussed with Mr. Stanley. Mr. Locher disagreed with the term "Ponding <br />area ". He felt that the situation may change and there would be another use <br />of this land that would serve a different purpose. <br />Mr. McLean moved to table consideration of these ponding areas until the June <br />9, 1980 meeting Seconded by Mr. Kulaszewicz. Motion carried unanimously. <br />The Public Hearing for the rezoning for. Rite -Way Waterproffing was called to <br />order at 9:30 P.M. There was no representative present. Mr. Schumacher felt <br />this rezoning is necessary for the financing of their project. There was no <br />testtimony from the audience. Mr. Schumacher read the legal notice of publi- <br />cation. <br />Mr. Jaworski moved to continue this hearing to June 9, 1980 at 9,:00 P.M. <br />Seconded by Mr. McLean. Motion carried unanimously. <br />The public hearing on the Street Lighting and Street Name Signs was called to <br />order at 9:55 P.M. Mr, Locher read a copy of the Ordinance. <br />Mr. Schumacher has researched several questions the Council had brought up at <br />the last meeting. The $100.00 deductible is per occurance, regardless of how <br />many poles are damaged. He had also checked the rate differential - the basic <br />difference is installation costs. This accounts for the greater amount in the <br />electricity cost. Mr. Schumacher felt this is a good deal for this City. <br />Mr. Schumacher felt there must be close cooperation between the developer and <br />NSP in order to have fixtures installed that would conform to NSP requirements. <br />Mr. McLean moved to approve Ordinance No. 21C. Seconded by Mr. Jaworski. <br />Motion carried unanimously. <br />Mr. Jaworski moved to close the hearing. Seconded by Mr. McLean. Motion <br />carried unanimously. Time: 9:45 P.M. <br />The petition from the land owners on Andall Street was considered. This is a <br />petition for the upgrading of that street. This has been signed by all four <br />owners. <br />Mr. Carley said a feasibility study is necessary. Moved by Mr. Jaworski. <br />Seconded by Mr. Kulaszewicz. Motion carried unanimously. <br />Mr. McLean moved to accept this petition. Seconded by Mrs. Elsenpeter. Motion <br />carried unanimously. <br />Mayor Gourley asked if the owners should be notified. Mr. Carley said this <br />information would be available for the June 9, 1980 meeting. This is to be <br />
