July 28, 1980 <br />147 <br />Mr. Meister said this is a part of the developer's agreement that is used effectively <br />in other Cities, and felt this should be in practice by this City. There was some dis- <br />cussion on this point and the reasons for this requirement. <br />Under this discussion, the probFem with LaMotte Road was discu$Sed. There was a sug- <br />gestion that perhaps the undermat could be used in this area. Mr. Meister is to have <br />some recommendations and cost figures for the Council by the next meeting. This is <br />to be put on the August 11, 1980 agenda. <br />Mr. Carley and Mr. Meister reported on the problem in Shenandoah with the service that <br />had been destroyed when the lift station had been installed. Mr. Glenn Rehbein has <br />been billing the City but the problem is Metropolitan Waste Controls' amd should be <br />paid by that agency. <br />Mrs. Elsenpeter asked who is to surface that portion of the street - Totem Trail. <br />The general consenus of the Council was this is the responsibility of Glenn Rehbein. <br />Mr. Jaworski moved to withhold this cost from the SAC submittal and to write Mr. <br />Rehbein that he will be paid when the street is surfaced. A letter to be written to <br />Metropolitan Waste Control Commission informing them of the City's actions in this <br />matter and a letter to Mr. Rehbein informing him of this decision. The letter to <br />MWCC to be sent to Mr. Richard Dougherty. Seconded by Mr. McLean. Motion carried <br />unanimously. <br />The proposed street specifications was discussed. Mayor Gourley asked Mr. Meister <br />to go through this proposal. This sets forth the requirements of having the plans <br />of each project certified and signed by a registered engineer. The street be de- <br />signed for 7 ton maximum load with a minimum of 400 cars per day. This would also <br />require soil borings to establish the bearing of the soils and this would determine <br />the base needed and the surface needed. This also included the Procter test that <br />had just been approved by the Council. All these tests will be done by a soil testing <br />lab and paid for by the developer. This also includes a one year warranty on the <br />construction of the street. <br />Mr. McLean suggested these specs be given to Mr. Locher to incorporate into the exist- <br />ing Ordinance and have ready for the next Council meeting. <br />Mr. Meister noted that this requires that the City Engineer prepare the plans and <br />specifications. <br />The next item on the agenda was the developer's agreement. Mr. Meister said this is <br />proposed to give the City and the Engineer more control on the installation of streets <br />and the development of the project. Mayor Gourley asked if this gives more control <br />than the existing ordinandes and Mr. Meister wasn't sure. <br />The Public Hearing for consideration of Ordinance 56M was called to order at 11:15 P.M. <br />Mayor Gourley asked if there was any comments from the Audience and there was none. <br />Mayor Gourley asked if there was any comment from the Council. Mr. Jaworski suggested <br />the portion referring to Ordinance 73 be deleted. Mr. Locher said this is permissable. <br />Section 6.04 (F) delete the following " In Ordinance No.73 and any of its subsequest <br />revision or amendments" Mr. Kulaszewicz moved to adopt 56M as corrected. Seconded <br />by Mrs. Elsenpeter. Motion carried unanimously. <br />Mr. Jaworski moved to close the hearing at 11:20 P.M. Seconded by Mr. McLean. Motion <br />carried unanimously. <br />Mr. Forest Tagg had arrived to discuss his special use permit. This was for the manager's <br />living quarters for his motel. Mayor Gourley pointed out this is allowed under the <br />
