1 <br />1 <br />1 <br />July 28, 1980 <br />Item Three - a variance request from Mr. Brown for thr division of a lot and the moving <br />of a house onto the lot. This is two variance requests on one application - 1) to <br />split the lot 2) vary the minimum square footage. <br />This house is proposed to be moved onto a sot on W. 77th street just North of 135W. <br />This house had also been inspected and found the construction is good. There was <br />discussion on this home not being compatible with this area. <br />This house need 96 square feet to qualify for the required footage. Mr. Brown was <br />asked if he had any plans for the enlargement of this home. Mr. McLean felt this <br />should be denied unless a plan is presented for the enlarging of this home. <br />Mayor Gourley suggested deleting the variance request for the house and consider the <br />lot split at this time. Mr. McLean moved to approve the variance for the splitting <br />of the lot. Seconded by Mr. Kulaszewicz. Motion carried unanimously. <br />Mayor Gourley suggested the moving of the house could be approved provided the house <br />is brought up to the required footage. Mr. Kulaszewicz moved to approve this request <br />with that stipulation. Seconded by Mr. McLean. Motion carried unanimously. <br />Mr. Brian Dobie had requested Tracts A & Q to be rezoned to R -2. These lots border <br />Main Street on either side of Wood Duck Trail. Mrs. Elsenpeter moved to set a public <br />Hearing on this rezoning for August 28,1980 at 8:00 P.M. Seconded by Mr. Kulaszewicz. <br />Motion carried unanimously. <br />The Planning and Zoning Board had requested a ten year review of the special use per- <br />mit and the platting procedures concerned with the Country Lakes development Mr. <br />Schumacher felt the Council had made a decision that the special use permit had been <br />declared valid and the Planning and Zoning Board should make a decision on the pre- <br />liminary plat based on that decision. <br />Mr. Schumacher suggested that the Board meet 30 minutes early to discuss this problem. <br />Mayor Gourley felt that three things should be conveyed to the Planning and Zoning <br />Boar 1) the Council has made a decision on this special use permit; 2) the P &Z <br />should be reviewing the plat in relationship of its conformity to the City Ordinance <br />and 3)the Council will sit down with the Planning and Zoning Board and discuss their <br />role as a planning commission. <br />The next item was consideration of amending the ordinance on platting fees. Mr. Mike <br />Johnson had researched the past three years in reference to the average costs for the <br />plats completed. His recommendations was for the platting fees to be increased to <br />$500.00. <br />Mayor Gourley asked Mr. Locher, if the total fees come in less than the $500.00, <br />does the ordinance provide for a refund? There was some discussion on this matter <br />with Mr. McLean suggesting that the entire group of fees and return to the Council <br />with a proposal. The Council agreed with this procedure. <br />The next item was consideration of the 1980 -81 Labor Contract for the Maintenance <br />personnel. Mr. Schumacher pointed out the changes in this contract. 10% salary in- <br />crease for 1980 - 9% for 1981 and 2.77 per month increase in H &W benefits for 1981. <br />The salary increase will be retroactive to January 1,1980. The Council discussed the <br />various points in this Contract, with Mr. Schumacher answering the questions. Mr. <br />Jaworski moved to approve this contract. Seconded by Mr. McLean. Motion carried <br />unanimously. <br />
