1 <br />February 9, 1981 <br />removed. <br />The general consensus was that in order for Mr. Ross to keep this building, it must <br />be brought up to code within, a certain period of time. Mayor Gourley suggested 90 <br />days to get the permit and 90 days to complete it. <br />Mr. McLean moved that Mr. Clifford Ross, Sr. be offered the option to bring his build- <br />ing up to code and evidence of this will be his submission within 30 days from this <br />date of, all the necessary documentation for a building permit. And if at the end of <br />30 days, Mr. Ross has not made application for the building permit, then the matter will <br />be referred to the. City Attorney to pursue condemnation of the building as a hazard- <br />ous building. <br />Mr. Schumacher pointed out that in allowing Mr. Ross to renovate this building, they <br />would be allowing a non - conforming use to continue and Mr. Schumacher, felt this <br />could create a problem in the same sort of situation in the future. <br />Mayor Gourley amended the motion that in the event that Mr. Ross does not succeed in <br />obtaining a building permit within 30 days, he would like the City Administrator to <br />be empowered at this time to contract the necessary professionals and to proceed with <br />a law suit without further action of this Council. <br />Mr. Jaworski seconded the motion and accepted the amendment as did Mr. McLean. Motion <br />carried unanimously. <br />The next item on Mr. Locher's report was a report on the Baldwin Lake sewers. Mr. <br />Locher reported that,he had talked to Mr....Howard and has an agreement with Mr. Webster <br />and has an agreement with Mr. Morrison, who does not wish to make a final decision un- <br />til after the informational meeting to be held on Feb. 26, 1981 to discuss the feas- <br />ibility of sewers along #49. <br />This project will be paid for by Mr—Howard - there will be no assessments in the area. <br />Mr. Locher reported . on the Contract for Animal Control. He said this is one that has <br />been used before and essentially is the same except for changes in the fees. Mr. <br />Locher pointed out that this contract has a provision for cancellation, by either <br />party with a 30 day written notice, however, this is a two year contract. <br />There were questions and answers on the matter of how the animals are handled, and <br />how they are put to sleep. <br />Mr. Jaworski moved to table this contract. Seconded by Mr. McLean. Motion carried <br />unanimously. <br />Mr. Locher reported on the supplemental assessment on the Black Duck project. He had <br />given a copy to the Clerk who must recompute the interest from Sept. 9, 1979 through <br />Dec. 31. 1980, be certified for collection in 1982. Notices must be sent 10 (ten) <br />days prior to the meeting scheduled for March 9, 1981 - but it is not necessary to <br />publish. The notices should include the amount and the reason why this is necessary. <br />Mr. Locher had prepared a Resolution for the use of the Certificate of Indebtedness <br />for the purchase of the front end loader and the snow blower attachment. (A copy is <br />attached to the end of these minutes.) <br />Mr. McLean moved to adopt this Resolution with the proper amounts inserted. Seconded <br />by Mr. Jaworski. Motion carried unanimously. <br />
