- 023. <br />COUNCIL MEETING <br />March 10, 1986 <br />Page Five <br />Mr. Marier suggested that the City Administrator draw up the crit- <br />eria the Committee should be involved in and then bring this to <br />the Council for its review. He felt the proposal from Ms. Apitz <br />was too ambiguous. <br />Mayor Benson asked Mr. Schumacher to put together criteria for a <br />Review Board with citizen input. Mr. Schumacher said he would like <br />to model this after the present policies the City has dealing with <br />citizen committees. <br />ENGINEER'S REPORT <br />A. Circle Pines Joint Watei Service Agreement - Mr. Toddie has <br />received a letter from Circle Pines indicating they would provide <br />water to the Rice Lake Area for 55 per 1,000 gallons. He felt this <br />was a reasonable rate. He also noted that Circle Pines is preparing <br />a draft water service agreement. <br />Mr. Schumacher said that Mr. Volk is concerned about litigation re- <br />garding contaminated wells and requested language be put in the <br />agreement regarding the responsibility of contaminated wells. The <br />City Attorney has reviewed this draft agreement and had no problem <br />with it. <br />Mayor Benson asked Mr. Schumacher to note the items to be changed in <br />the agreement including Mr. Volk's suggestion regarding contaminated <br />wells and suggested that when the Circle Pines Draft Agreement ar- <br />rives this can be given to the City Attorney for his comments and <br />be brought forward to the next Council Meeting for Council review. <br />B. Rice Creek Watershed District Funding for County Ditch #22, and <br />C. 4th Avenue NSP Funding Policy - Mr. Toddie noted the work session <br />held earlier this evening and reminded the Council of the Citizen <br />Informational Hearing to be held Monday, March 24, 1986 at 7:35 P.M. <br />Mayor Benson asked that it be determined prior to the Informational <br />Meeting exactly what the Rice Creek Watershed District is going to <br />commit to, what the County will commit to and what is the Developer's <br />(Nelson Properties) fair share. Was the Developer able to develop <br />more land than he should have developed? Has the City and the new <br />home owners been hurt by this? <br />Mr. Bohjanen asked if Mr. Toddie could determine how far of an area <br />can this improvement benefit property owners. Mr. Toddie explained <br />there are two areas involved. One area involves the storm water <br />drainage along 4th Avenue and the other is a much larger area bene- <br />fited by the ditch maintenance project. <br />
