This matter was discussed one month later and Mr. Hawkins noted that the Circle Pines gas franchise would be amen- ded to serve the Rice Creek Estates Area and that North Central already has that right. Therefore, the two utilities would be free to compete with each other. Mr. Burke said the information and service given by Mr. Hawkins then is still valid today. So if the Council is considering denying an opportunity to serve there must be a basis for denial. If there is no legitimate basis for denial the City would be exposing itself to a claim that the City is favoring one utility over another. The City could face a potential anti -trust claim. There was discussion regarding what would happen if the City oper- ated its own gas company. Could the City then exclude other gas companies? Mr. Marier moved to obtain an opinion of an anti -trust attorney in this matter. Mr. Bohjanen seconded the motion. Motion declared passed. B. Consideration of Gambling License Renewal - St. Joseph's Cath- olic Church. There were no objections to this license application and no action by the Council was required. C. Consideration of Liquor License Renewals. Mrs. Anderson ex- plained that she had received the required certificates of insur- ance and bonds for all license holders except Ross' Corner Bottle Shop and Lee's of Lino. Chris Ross had provided a certificate of insurance but the limits of liability did not meet City Code. He has indicated he will have the correct certificate by June 30, 1986. Lee's of Lino have not provided the two surety bonds and the cer- tificate of insurance. Mrs. Anderson explained this happens each year. The Chief of Police has provided a letter stating he has investi- gated all license holders and has not found any problems. Mrs. Anderson explained she has talked to the state liquor control board and found there is a problem in providing the required in- surance in a timely matter throughout the state. The liquor control board did say that the Council could approve the licenses pending receipt of the proper documents. Mrs. Anderson cannot submit the license applications to the state until all documents are present. Mr. Marier moved to approve the renewal of all liquor licenses pend ing receipt of the proper documents and Mrs. Anderson is to send a
