126 <br />COUNCIL MEETING <br />June 23, 1986 <br />Page Ten <br />the number of companies who provide that type of service within <br />the City. This matter was discussed one month later and Mr. <br />Hawkins noted that the Circle Pines gas franchise would be amen- <br />ded to serve the Rice Creek Estates Area and that North Central <br />already has that right. Therefore, the two utilities would be <br />free to compete with each other. <br />Mr. Burke said the information and service given by Mr. Hawkins <br />then is still valid today. So if the Council is considering <br />denying an opportunity to serve there must be a basis for denial. <br />If there is no legitimate basis for denial the City would be <br />exposing itself to a claim that the City is favoring one utility <br />over another. The City could face a potential anti -trust claim. <br />There was discussion regarding what would happen if the City oper- <br />ated its own gas company. Could the City then exclude other gas <br />companies? <br />Mr. Marier moved to obtain an opinion of an anti -trust attorney in <br />this matter. Mr. Bohjanen seconded the motion. Motion declared <br />passed. <br />B. Consideration of Gambling License Renewal - St. Joseph's Cath- <br />olic Church. There were no objections to this license application <br />and no action by the Council was required. <br />C. Consideration of Liquor License Renewals. Mrs. Anderson ex- <br />plained that she had received the required certificates of insur- <br />ance and bonds for all license holders except Ross' Corner Bottle <br />Shop and Lee's of Lino. Chris Ross had provided a certificate of <br />insurance but the limits of liability did not meet City Code. He <br />has indicated he will have the correct certificate by June 30, 1986. <br />Lee's of Lino have not provided the two surety bonds and the cer- <br />tificate of insurance. Mrs. Anderson explained this happens each <br />year. <br />The Chief of Police has provided a letter stating he has investi- <br />gated all license holders and has not found any problems. <br />Mrs. Anderson explained she has talked to the state liquor control <br />board and found there is a problem in providing the required in- <br />surance in a timely matter throughout the state. The liquor control <br />board did say that the Council could approve the licenses pending <br />receipt of the proper documents. Mrs. Anderson cannot submit the <br />license applications to the state until all documents are present. <br />Mr. Marier moved to approve the renewal of all liquor licenses pend <br />ing receipt of the proper documents and Mrs. Anderson is to send a <br />
