COUNCIL MEETING <br />June 23, 1986 <br />Page Nine <br />Mr. Bainbridge of 877 Orange Street told the Council that his <br />house was built below street level and as a result he has a pond <br />in his front yard every time it rains. He felt curbs would help <br />his situation. He also commented that since there is a storm <br />sewer located near the west end of the street it could better be <br />used by installing the curbs. <br />Mrs. Johnson, 902 Orange Street, told about the flooding problems <br />that has occurred in her yard. Mr. Johnson said in previous years <br />the water ran through their yard to the area that is now Olive <br />Street. However, since the new houses have been built there is <br />no place for the water to run except into the residents yards. <br />Mr. Bainbridge asked if curbing and storm sewers are proposed for <br />Olive Street. Mr. Stallberg said no. <br />Mayor Benson noted the engineers cost estimate for this work is <br />$27,970 or $8.00 per foot. Mrs. Johnson told the Council she <br />did not feel it was the responsibility of the residents to pay <br />for installation of curbing on Orange Street since the City al- <br />lowed a development on Olive Street where storm water did accum- <br />ulate. Also the water that is ending up on their lots is coming <br />from Lake Drive. Therefore, they do not feel it is their re- <br />sponsibility to handle all this water. <br />Additional information such as plat requirements for curbs and gut- <br />ters and what the requirements were for the newer development in <br />the plat was requested by Mayor Benson. It was noted that the <br />streets are of rural design with ditches to be installed. Mr. <br />Stallberg said there was very little ditching in this area. <br />Mr. Marier moved to table this matter until the next Council Meet- <br />ing so that the minutes can be examined to determine what the <br />street requirements are for this area. Mr. Bisel seconded the <br />motion. Motion carried unanimously. <br />Mrs. Anderson will let the residents know what time it is on the <br />agenda. <br />ATTORNEY'S REPORT - JOHN BURKE <br />A. Consideration of Application Received from North Central Public <br />Service for Service to Rice Lake Estates - Mr. Burke explained that <br />the City Attorney had presented information to the City Council in <br />July., 1984 regarding the part anti -trust laws would play in this <br />matter and the limits placed on City Councils when granting fran- <br />chise. Mr. Hawkins had pointed out that the City cannot pick and <br />choose between companies serving the City as long as the companies <br />provide proper service in a timely manner.
