011 <br />1 <br />COUNCIL MEETING MARCH 9, 1987 <br />office and we have a contract with TKDA that states all projects are <br />the property of the City. <br />Mr. Reinert moved to approve the Authorization for Professional <br />Services - Comprehensive Sanitary Sewer Plan Update for Urban Service <br />Districts No. 1 and No. 2. Mr. Bisel seconded the motion. Motion <br />carried unanimously. <br />Marvin Tews Culvert Problem - Mr. Volk said he and Mr. Stahlberg have <br />looked at this situation from several viewpoints. Mr. Tews does have <br />a problem getting to a portion of his property, however his neighbor <br />to the north has the same problem and looking at the entire 4th Avenue <br />project, there will be several other landowners with the exact same <br />problem. The question is, if the City installs a culvert for Mr. <br />Tews, will the City be setting a precedence and opening itself up for <br />a great deal of costs. In this case a 12" culvert will not be <br />sufficient and the costs could be fairly large. Mr. Volk suggested <br />that there were three ways this situation could be handled: 1) Do not <br />do anything at all, 2) the City get a permit from Rice Creek Watershed <br />District and install the culvert and add the cost to the 4th Avenue <br />project and 3) split the cost with Mr. Tews. Mr. Stahlberg noted that <br />RCWD could have gone after Mr. Tews and made him remove the culvert <br />that was there before the ditch cleaning because it was acting as a <br />dam. <br />Mayor Benson asked Mr. Schumacher to relay to Mr. Tews the <br />alternatives listed. If he wants to come back before the Council he <br />can be scheduled at a later date. Mr. Schumacher said Mr. Tews will <br />probably state he had access to the property on the north side of the <br />ditch prior to the reconstruction and wants it back again. Mayor <br />Benson asked that Mr. Schumacher get a legal opinion on this question. <br />Mr. Stahlberg referred to Mr. Tews remark at the last Council meeting <br />that this ditch was not a legal ditch. He asked that Mr. Hawkins <br />research the legal status of this ditch. <br />Surplus Pipe - Mr. Stahlberg told the council that there is some 48" <br />tongue and groove culvert available for very little cost. He <br />explained it could he useful on the 4th Avenue project in the deep <br />ditch that is to be constructed at 4th Avenue and Lilac Street. He <br />believes that he can possibly get approximately 450' for $2,000 to <br />$3,000. Mr. Stahlberg will look into this situation and get the cost <br />for installing this culvert on 4th Avenue. <br />ATTORNEY'S REPORT - BILL HAWKINS <br />Mr. Burke did not have a report from Mr. Hawkins <br />1 Page 7 <br />
