1 <br />1 <br />107 <br />COUNCIL MEETING MAY 11, 1987 <br />this City requires for subdivisions and explained the design of the <br />street. <br />Mr. Schumacher asked about the day camp proposed for the Ramsey County <br />Open Space. Mr. Holmberg said this is in the ten year Capital <br />Improvement Plan and is not slated for completion until after that <br />time. Mr. Stahlberg asked if Ramsey County has any method of <br />recovering some of the costs because of the Regional Park. Mr. <br />Holmberg said if they are assessed and choose not to appeal they would <br />request Metro Council funding and this would be subject to whatever <br />Metro feels is necessary to the operation of that facility. <br />Mayor Benson asked who would decide if the County would participate in <br />the assessment. Mr. Holmberg said the County Board would decide if <br />they would appeal the assessment. <br />Robert Adamson, Owner of Otter Bay Plat - Mr. Adamson asked the <br />Council how the improvement of Ash Street is going to affect their <br />development. Mayor Benson said this proposal is somewhat different in <br />that there are two other entities to deal with. The end result may be <br />that the Council feels the improved street benefits all lots in Otter <br />Bay and may assess all of them. Mr. Reinert said the street will <br />primarily benefit the Otter Bay subdivision. Mr. Adamson asked who has <br />been maintaining the street. He asked since the City has been the <br />principal owner don't they have the responsibility to upgrade it. Mr. <br />Marier told Mr. Adamson that the benefited property usually pay the <br />assessments. Mr. Adamson asked if this was going to tie up his <br />project. Mr. Stahlberg said that Mr. Adamson could build his road and <br />build his houses. The plat and plans and specifications are being <br />prepared. <br />Mayor Benson asked what would be the legal position of the City if all <br />of Mr. Adamson's lots were assessed. Mr. Hawkins said the City would <br />have to prove that those lots benefit from the improvement. Appraisal <br />information would be needed. <br />Mr. Marier moved to close the public hearing at 8:24 P.M. Mr. Bisel <br />seconded the motion. Motion carried unanimously. <br />Mr. Reinert moved to have Mr. Stahlberg get together with White Bear <br />Township and resolve the issues before the final plat is considered. <br />Mr. Marier seconded the motion. Motion carried unanimously. <br />Mr. Adamson said if the Council plans to hold up his revised plat he <br />will probably go back to his plat of 1979. Mr. Reinert said it was <br />not the intent of the Council to hold up his plat. <br />
