1 <br />1 <br />1 <br />COUNCIL MEETING JUNE 8, 1987 <br />Item No. 33 is a Conditional Use Permit for Richard Klenck, 2260 <br />Rolling Hills Drive to operate a contract hauling business from his <br />home with the parking and storing of two dump trucks only to go in and <br />out empty with an annual review of July 1st of each year and the <br />permit is non - transferable and issued to Mr. Klenck only. Mr. Kluegel <br />explained the Police Department and the Public Works Department have <br />received numerous complaints about trucks entering the property over <br />weight and breaking up the street. Mr. Kluegel said he has personally <br />witnessed an oil truck, boat and truck camper on the premises but has <br />not personally witnessed over loaded dump trucks. Mr. Marier asked if <br />it is always the same person making the complaints. Mr. Kluegel said <br />no, some complaints have come from White Bear Township residents. <br />Chief Campbell explained the complaints he has received have been <br />anonymous and his officers have not witnessed any violation of the <br />Conditional Use Permit. <br />Mrs. Klenck explained that no one has ever come to their residence <br />complaining of over loaded trucks and there has been no break up of <br />Rolling Hills Drive. The condition of Rolling Hills Drive depends on <br />the weather. She also told the Council that Mr. Klenck has purchased <br />some property outside of Lino Lakes and plans to move his truck <br />operation to the new location. She told the Council that she has <br />noted that Lino Lakes does seem to be a friendly place to be and does <br />not want businesses here. <br />Mr. Reinert asked Mr. Kluegel to read the conditions of the <br />Conditional Use Permit. Mr. Kluegel did this and Mr. Reinert said <br />that the conditions are specific, trucks cannot enter the property <br />loaded. Mrs. Klenck said they do comply with the conditions on the <br />permit and have invited people to inspect their property but no one <br />has ever done this. Mr. Reinert said that there is not enough proof <br />of any violation on the permit. <br />Mr. Marier moved to continue the Conditional Use Permit for Richard <br />Klenck until proof of violations can be obtained. Mr. Bohjanen <br />seconded the motion. Motion carried unanimously. <br />Item No. 46, Frank and Kathy Sampair, 7393 -- 24th Avenue - Conditional <br />Use Permit for a commercial horse stable to include the activities of <br />riding lessions, training, boarding, breeding, sales of horses and <br />tack, provided that the driveway and parking area be covered with a <br />substantial rock -type paving. Mr. Kluegel explained that there have <br />been numerous complaints about rodents in wood chips piled on this <br />property and letters and complaints have been written. <br />Mr. Bob Powers, resident of the City of Hugo across the street from <br />the Sampair residence spoke to the Council regarding health, nuisance <br />and economic concerns about the condition of the Sampair property.
