COUNCIL MEETING JUNE 22, 1987 <br />and gave the Clerk his written resignation. He told the Council his <br />six years as representative were at times trying but very rewarding. <br />The Council expressed their appreciation to him and asked that a <br />letter of appreciation be written to Mr. Johnson <br />Judy Domning, 948 Birch Street - Mrs. Domning explained she had sent a <br />letter to Mayor Benson with copies to the Council and Mr. Hawkins <br />explaining the situation regarding the zoning of her property. The <br />home was built in a residential area in 1974. At that time proper <br />permits were obtained and the home was built with a mother -in -law <br />apartment on the second floor. Recently she tried to obtain a <br />federally backed mortgage on the property. The appraiser told her <br />that the property was classified as non - conforming and determined that <br />the mother -in -law apartment could be used for a rental unit in the <br />future. Mrs. Domning explained that this was not the intention when <br />the home was built. However, if the house was sold it certainly could <br />be used as a duplex. Now they cannot get a mortgage because if the <br />house were to be destroyed it could not be rebuilt as it is now <br />constructed thereby lowering the value of the home. Mayor Benson <br />explained that a similar problem was expressed early in May by another <br />resident. Mr. Hawkins explained that he was not familar with this <br />problem and suggested a different type of mortgage was available. <br />Mrs. Domning agreed, however they wished to take advantage of the low <br />interest offered by the federal programs. Mr. Hawkins said that the <br />problem for the Council would be, does the Council want the federal <br />government controlling the zoning in Lino Lakes. Mr. Hawkins said the <br />issue is what is this City's obligation regarding non - conforming uses? <br />There was discussion regarding how the application for a mortgage was <br />written, how the house was appraised and whether a letter from the <br />City would clarify the position of the property. <br />Mr. Marier moved to write a letter to the potential mortgage company <br />stating that the property is zoned single family residential and is <br />used as such and is conforming to the Zoning Ordinance in this area. <br />Mr. Bohjanen seconded the motion. Mr. Hawkins suggested that the City <br />Planner should prepare this letter. After further discussion, Mr. <br />Marier and Mr. Bohjanen withdrew the motion. The City Planner will <br />draft a letter indicating how the land is used today. The Council <br />will review this letter at the next Council meeting. <br />John MacDonald, 6901 LaMotte Drive - Mr. MacDonald thanked the Council <br />for the consideration given to improving the ditch that runs from <br />Center Oaks in Centerville to Centerville Lake. He asked what the <br />Council plans to do about the siltation problem in Centerville Lake. <br />Mr. Schumacher outlined a meeting with RCWD and Anoka County and its <br />results regarding cleaning the ditch.
