Mr. Volk said <br />he does all of Regency Homes construction. <br />Voting on the motion, motion carried unanimously. <br />Seal Coating - Mr. Volk told the Council that seal coating would begin <br />late next week. <br />ENGINEER'S REPORT - RON STAHLBERG <br />Final Plat, Otter Bay - Mr. Stahlberg explained that the final replat <br />of Arbor Lakes now known as Otter Bay has been completed and all is in <br />order except for the upgrading of Ash Street to this plat. He <br />explained that the Ramsey County Board had met and issued a resolution <br />refusing participation in the proposed reconstruction of Ash Street <br />and assessments and recommending that White Bear Township enter into a <br />Joint Powers Agreement with Lino Lakes whereby Lino Lakes would bear <br />all costs for reconstruction and maintenance, Ramsey County would not <br />pay assessments against the Park property and White Bear Township <br />would accept ownership and responsibility for the southern half of the <br />road from the County. White Bear Township does not agree with this <br />resolution and will be meeting with the Ramsey County Park Board. <br />White Bear Township would like a Joint Powers Agreement with Lino <br />Lakes and there will be further information on this. <br />Mr. Stahlberg, Mr. Hawkins and Mr. Schumacher met with the owners of <br />the Otter Bay plat and are proposing the following: the City Council <br />approve the final plat of Otter Bay subject to Mr. Adamson agreeing to <br />pay the special assessments against his lots and providing slope <br />easements and approve plans and specifications for the improvement of <br />Ash Street to include the final bituminous surface. The developers <br />agreement will contain language and documents regarding special <br />assessments and slope easements. <br />Mr. Hawkins explained the plan is to construct Ash Street according to <br />the normal street specifications except for the black top and assess <br />the Lino Lakes property abutting the street including all of Mr. <br />Adamson's lots. The normal assessment procedure will be followed with <br />this City assessing the Ramsey County Park for their share. When the <br />assessment procedure has been completed and Lino Lakes is assured that <br />Ramsey County Parks will pay their fair share, the bituminous surface <br />will be completed. If Ramsey County Parks contests the assessments <br />and wins, the street will not be blacktopped. At least there will be <br />a gravel street constructed to City standards which can be blacktopped <br />in the future. Mr. Hawkins also noted that he feels this City has a <br />good chance at successfully assessing Ramsey County Parks. <br />PAGE 6 <br />
