155 <br />1 <br />1 <br />1 <br />COUNCIL MEETING JUNE 22, 1987 <br />Mr. Bisel moved to accept the final plat of Otter Bay contigent upon <br />the completion of a developers agreement to include the 35% letter of <br />credit for the assessment and a letter of credit for 150% of the <br />interior road construction and contingent upon acquisition of slope <br />easements for reconstruction of Ash Street. Mr. Bohjanen seconded the <br />motion. <br />Mr. Jim Oreson, attorney for Mr. Adamson addressed the Council. He <br />explained the reason Mr. Adamson needed approval of the final plat <br />this evening and noted that. Mr. Adamson has agreed to pay 14 /l6ths of <br />the total asessment just to get this approval. He further explained <br />that Mr. Adamson already had an approved plat, however the layout of <br />the plat was not as good as the proposed Otter Bay plat. If the <br />approval was not given tonight, Mr. Adamson might be forced to proceed <br />with construction of the first plat to insure finalizing the sales <br />that were already started. Mr. Reinert told Mr. Oreson that the City <br />does not want Mr. Adamson to compound the problem in this area of the <br />City by constructing additional homes on a street that certainly will <br />cause the new residents to complain about its condition. Mr. Hawkins <br />told the Council that Mr. Adamson is right, he does have an approved <br />plat that can be constructed now without any further approvals from <br />this City. <br />Mr. Marier said he felt that Lino Lakes does not own that portion of <br />Ash Street and also when development is made in a particular area <br />whoever needs the street, pays for the street. He felt that Mr. <br />Adamson had a certain responsibility in the upgrading of that street. <br />Mr. Oreson said that Mr. Adamson is paying for 14 /16ths of the first <br />stage as outlined by Mr. Hawkins and this should be his fair share. <br />Voting on the motion, motion carried with Mr. Marier voting no. <br />Mr. Schumacher asked for clarification of the motion, is the motion to <br />approve without a joint powers agreement with White Bear Township? <br />Mr. Hawkins explained that the worst thing that could happen is that <br />this City would end up with a gravel street that will be built to <br />specification. <br />Ash Street Sewer and Water, Resolution No. 28 - 87 - Mr. Stahlberg <br />reminded the Council that bids were received on this project and all <br />of the bids were more than 10% over his estimate. He has contacted <br />several contractors and has found one who will perform the work on a <br />day labor basis. The total cost of the work will be near the original <br />estimate. Mr. Reinert moved to adopt Resolution No. 28 - 87 <br />authorizing the project with day labor. Mr. Bohjanen seconded the <br />motion. Mr. Marier asked for a clarification of this Resolution. Mr. <br />Stahlberg explained that this Resolution rejects all bids received for <br />the project and authorizes the Engineer to proceed with the work using <br />PAGE 7 <br />
