1 <br />1 <br />1 <br />COUNCIL MEETING <br />September 8, 1.98€ <br />Page Nine <br />WHEREAS: In its study, it is considering potential refunds to <br />cities which have paid SAC fees for areas which will <br />not receive service in the near future, and <br />WHEREAS: A large portion of the City contain areas for which <br />SAC charges were collected but remain outside of our <br />Urban Service District, and are therefore unable to <br />receive service, and <br />WHEREAS: <br />In a comparative ratio of SAC fees collected to service <br />hookups in the metropolitan area, the City of Lino Lakes <br />has paid more SAC fees and received one of the fewest <br />number of hookups, <br />NOW THEREFORE BE IT RESOLVED, that the Lino Lakes City Council hereby <br />requests reimbursement of SAC fees collected by the Metropolitan <br />Waste Control Commission since 1973 for areas which will not receive <br />service availibility and therefore receive no benefit. In addition <br />the City Council requests that the Metropolitan Waste Control Comm- <br />ission act on this request in an expiditious manner. <br />Adopted by the City Council of Lino Lakes the 8th day of September, <br />1986. <br />Benjamin G. Anderson, Clerk - Treasurer <br />CONSIDERATION OF AWARDING BIDS FOR BLACK DUCK LOTS <br />Mr. Schumacher explained the lots on Black Duck were offered for <br />bid last winter and the bid was awarded to Roger Nelson. Mr. Nelson <br />has not closed on the lots and has been stalling for several reasons <br />and in June he was;tdldto complete the closing within 10 days. Mr. <br />Nelson did not close and the lots were rebid. Mr. Ed Vaughan, 104 <br />Wildwood Avenue, White Bear Lake bid $15,750.00 for all lots and <br />Regency Homes, Inc., 3825 - 85th Avenue North, Brooklyn Park bid <br />$17,000.00. <br />Mr. Bisel felt Mr. Nelson had an obligation to the City to honor <br />his bid and Mr. Hawkins felt the City had good basis for a lawsuit. <br />Mr. Marier moved to have Mr. Hawkins begin a suit against Mr. Nelson <br />to either close on the lots or recover damages. Mr. Bisel seconded <br />the motion. Motion declared passed. <br />011 <br />
