1 <br />COUNCIL MEETING <br />January 12, 1987 <br />Page Fifteen <br />Part of the Northwest (NW) quarter of the Northeast (NE) <br />quarter of Section 28, Township 31, Range 22, Anoka County, <br />Minnesota containing 36.7 Acres. <br />II. <br />Save as above amended, said Ordinance No. 2 shall stand as <br />initially passed and as previously amended. <br />III. <br />This Ordinance shall be in full force and effect from and after <br />its passage and publication according to City Charter. <br />Passed by the Council this <br />12 <br />day of <br />January <br />, 1987. <br />(e <br />Mari yn G. Anderson, Clerk- Treasurer <br />093 <br />Mr. Marier moved to approve the preliminary plat contingent upon <br />the engineers recommendations, contingent upon receipt of the final <br />grading plans and design of the wier. <br />Mr. Hawkins told the Council that they cannot require the developer <br />to install a chain link fence unless they consider the situation to <br />be a matter of urgent public safety. <br />Mr. Reinert told the developer that just spreading manure will be <br />a concern. This farmer will continue his operation. Mr. Dufrense <br />from the audience felt it was the duty of the developer to explain <br />this situation to potential buyers. <br />Regarding the chain link fence, Mr. Miers said he would share the <br />cost. Mr. Reinert said he was concerned about the hot fence. Mr. <br />Ficocello said he wished he knew of this concern when he met with <br />Mr. Miers previously. Mr. Schumacher said the old fence law could <br />be enforced and that procedure followed. Costs then would be shared. <br />Mr. Marier withdrew his motion. <br />Mr. Bisel moved to accept the preliminary plat to include the street <br />change on the western border and access to the south and the design <br />of the wier is to be comparable to the Uhde plat and resolve the <br />questions on soil borings and grading plan and boundary fencing to <br />be addressed before the final plat by the parties involved and <br />
