COUNCIL MEETING <br />January 26, 1987 <br />Voting on the motion, carried unanimously. <br />The second consideration is awarding bids for a dump body and <br />hoist. He recommended the low bid. Mr. Marier moved to <br />accept the low bid of $3,868.00 from J- Craft, Inc. Mr. Bohjanen <br />seconded the motion. Motion carried unanimously. <br />The Council took a five minute break at 8:55 PM. <br />ORDINANCE NO. 13 -86, CIRCLE PINES GAS FRANCHISE <br />Mr. Schumacher explained as directed on December 22, 1986, <br />he sent the proposed franchise to Circle Pines with instructions <br />that this Council receive a reply within 30 days. Circle <br />Pines would not accept the proposed franchise with the buy -out <br />language proposed by Lino Lakes. Mr. Schumacher, Mr. Hawkins <br />and Mr. Marier had spent time explaining to Circle Pines <br />that Lino Lakes could not accept their language because of <br />the City Charter. Mr. Jim Keinath, Cricle Pines Administrator, <br />was in the audience and explained that Circle Pines agreed <br />to the 7% franchise fee based upon the contigent that they <br />have a willing buyer in case they wanted to get out of the <br />franchise. He noted Circle Pines would like to negotiate <br />further. <br />Mr. Hawkins explained he could not recommend that Lino Lakes <br />accept Circle Pines' position. He did feel Circle Pines' <br />position was unreasonable and did not see where there could <br />be a compromise unless there was some clear way for Lino <br />Lakes to get out of the acquisition situation. He said he <br />felt very strongly from a legal standpoint that this should <br />not be accepted. <br />Mr. Marier felt that this situation be given one more try <br />so both cities come up with something they can live with. <br />He asked that he meet with the mayors of both cities, the <br />Administrators and Mr. Danheim. Mayor Benson said he was <br />not against meeting again but he felt the Circulating Pines <br />greatly influenced Circle Pines decisions and needed assurances <br />that Mr. Gibas is not telling the City of Circle Pines what <br />to do. <br />Mr. Schumacher will schedule a meeting as requested by Mr. <br />Marier. <br />Mr. Marier moved to table this item until the February 9, <br />1987, Council meeting. <br />1 <br />1 <br />
